A. 
The Borough of Eatontown shall be entitled to charge and collect fees for the reproduction of any public records, pursuant to N.J.S.A. 47:1A-5. The fee for the reproduction of public records pursuant to N.J.S.A. 47:1A-5 shall be $0.05 per letter-size page or smaller, and $0.07 per legal-size page or larger. The Borough shall be permitted to charge the actual cost of duplicating the record if it can demonstrate that the actual cost exceeds the foregoing rates.
B. 
The Clerk of the Borough of Eatontown and any other department so authorized under statute or ordinance shall, upon providing photocopies of documents requested, also charge the requestor for the following:
(1) 
Twenty-five cents for the envelope for any documents requested to be sent by mail.
(2) 
Photographs will be photocopied at the rate established herein. If requests are made for duplicate photographs, the actual cost of making the photograph shall be charged.
(3) 
Any item that cannot be photocopied by the Borough, or not otherwise provided for by ordinance, shall be subject to a charge based on actual costs incurred in making the copy.
(4) 
Where the request for documentation is obtained from an entity other than the Borough of Eatontown, the actual costs paid to the other entity shall be paid by the requestor.
(5) 
Duplication of videotapes constitutes an extraordinary duplication process and will be charged at a rate of $5 per videotape.
C. 
Any citizen who is seeking a copy of Planning Board or Board of Adjustment or other plans in the possession of the Borough shall obtain such copies at a sum of $6 for the first printed page of one set of plans (single-color prints) and $3 for each additional page of the same set of plans (single-color prints). Prints of more than one project shall be at the $6 for the first printed page of one set of plans rate. Plan requests for multicolor prints shall be at a fee of $8 for the first printed page of one set of plans and $4 for each additional page of the same set of plans. Fees under this subsection shall be paid to the department being requested for the service.
D. 
Should a citizen request information or documents in a medium not routinely maintained by the Borough or requiring substantial amount of manipulation or programming of information technology, then the custodian of records can charge the actual cost of duplication and a service charge that shall be reasonable and shall be based on the cost for any extensive use of information technology, or for the labor cost of personnel providing the service, that is actually incurred by the Borough attributable to the Borough for programming, clerical and supervisory assistance required, or both, per N.J.S.A. 47:1A-5.
E. 
The custodian of records shall also charge a requestor for information or documents and the cost of postage should the request include mailing of the documents to the requestor.

The fee for renting the pavilion at Wolcott Park shall be the sum of $250 for residents and $500 for nonresidents which, upon payment, shall permit the Director of Recreation to issue a permit for such use. Rentals of the pavilion shall be limited to a maximum of one five-hour block per day, during the hours of 10:00 a.m. to 3:00 p.m.; or 12:00 noon to 5:00 p.m.; or 1:00 p.m. to 6:00 p.m.

Any group, individual, team, league or organization that desires to have an authorized use for the Borough of Eatontown’s outdoor fields shall pay fees in accordance with the following criteria.
A. 
Usage fees.

(1) 
Those applicants meeting the definition of "resident" shall pay a fee of $50 per use (day or night), per field. This fee covers a two-hour time-frame, day or night, and the fee for each additional hour is $25 and shall become effective January 1, 2023.
(2) 
Those applicants not qualifying as "resident" shall pay a fee of $100 per use (day or night), per field. This fee covers a two-hour time-frame, day or night, and the fee for each additional hour is $50 and shall become effective January 1, 2023.
B. 
Reservation fees. In addition to the above fees, a field reservation fee is required. Individual teams are subject to nonrefundable fee of $150 per team. Leagues are subject to a nonrefundable fee of $100 per team. Individuals or organizations not specifically listed above under reservation deposit details are subject to a minimum, nonrefundable deposit of $200 per usage, the basis of which will be determined by the use on the field usage permit application.
C. 
The Borough of Eatontown through the Recreation Advisory Committee reserves the right to consider a fee waiver request based on Borough-endorsed festivities or activities, use by nonprofit organizations and activities and for special reasons as determined by the Recreation Advisory Committee. A fee waiver request must be made in writing and submitted to the Director of Recreation and Community Services at least one week prior to the next regularly scheduled meeting of the Recreation Advisory Committee for consideration at that meeting. The written request shall set forth the applicant’s justification for said fee waiver. The Committee's decision regarding fee waiver shall be binding and final.
D. 
The Borough of Eatontown, through the Recreation Advisory Committee, reserves the right to deny and/or cancel use of its fields/facilities at any time at its sole discretion. If such denial or cancellation is for reasons other than violations of the Borough’s rules and regulations concerning field usage, the Borough shall refund any outstanding fees to the applicant.
E. 
Definitions. For purposes of this section, unless the context clearly indicates a different meaning, the following definitions apply:
INDIVIDUAL
A specific person not affiliated with a team, league or organization.
LEAGUE
An association of multiple teams that compete with one another.
ORGANIZATION
A group of people with a shared interest or purpose, not belonging to or meeting the definition of a team or league as described herein.
RESIDENT
Proof of residency must be provided at the time of submission of the permit application, which is defined as an individual primarily residing or working in the Borough of Eatontown. To be considered a "resident" as a team, league or organization, a roster must be submitted demonstrating at least 51% of all players either living or working in the Borough of Eatontown. If the facility is being reserved for a "home team," then at least 51% of the team's roster must be comprised of players living or working in the Borough of Eatontown. Applicants requesting fields are honored on a first-come, first-availability basis.
TEAM
A singular identifiable group of people involved in the same activity, associated with an organized league of similarly situated teams.

A. 
The Police Department of the Borough of Eatontown shall furnish, where permitted or required, a copy of any videotaping made by the Police Department in the performance of any of its lawful functions. There shall be a fee for said copies based upon the sum of $5 per videotape. All such copies shall be made by the Police Department, original videotape being retained within the control of the Police Department, unless otherwise authorized by law or statute.

B. 
A firearms permit fee shall be $49 or that allowed by state statute presented to the Borough Police Department by certified check or money order made out to "Division of State Police - SBI" accompanied by a firearms form, mental health form, former address form and two fingerprint cards.
C. 
A firearms I.D. card fee shall be required in the amount of $5 paid to the Borough of Eatontown and accompanied by a firearms form, mental health form and duplicate purchaser I.D. card if for a change of address.

D. 
A handgun permit fee shall be required in the amount of $2 paid to the Borough of Eatontown and accompanied by a firearms form and mental health form.

E. 
All police records requests allowed by law shall be subject to a fee of $5 for the first three pages and $1 for every page after the first three or that which is set forth by state law.
F. 
The fee for a necessary criminal background check under Chapter 122 entitled "Child Care Centers" and under state law with regards to day-care centers shall be $30 or that required by state statute paid to "Division of State Police -SBI" accompanied by a day-care application, mental health form, two-inch photo of applicant and a fingerprint card.
G. 
Any application for a superintendent’s license shall be subject to a fee of $30 or that which is required by state law payable by certified check or money order to "Division of State Police - SBI" and accompanied by a superintendent’s application.
H. 
Any liquor license application requiring a criminal background check shall be subject to a fee of $53 or that allowed by state law by certified check or money order paid to "Division of State Police - SBI" and accompanied by a liquor license application.

A person applying for representation by the Municipal Public Defender or court approved counsel shall pay an application fee of $200. The Municipal Court may waive the application fee, in whole or in part, in accordance with Supreme Court guidelines, if the Court determines upon a clear and convincing showing by the applicant that the application fee represents an unreasonable burden on the person seeking representation.
A. 
Rules and regulations for use of the Eatontown Community Center.

(1) 
Definitions. As used in this Subsection A, the following terms shall have the meanings indicated:
NONPROFIT ORGANIZATION
A group or organization that operates exclusively for the public good and to promote community affairs.
(2) 
Permitted uses. The Community Center building may be used for meetings or special events sponsored or held only by nonprofit organizations operating within the Borough.
(3) 
Uses not permitted.
(a) 
Private social events including, but not limited to, private parties, weddings, and banquets.
(b) 
Political meetings or events.
(c) 
Profit-making activities, such as the conducting of sales of goods or services or any other private enterprise.
(4) 
Scheduling of events. Meetings or activities scheduled to occur on a regular basis may not be scheduled more then 12 months in advance so as not to permit any one group to monopolize use of the facility.
(5) 
General regulations.
(a) 
No alcoholic beverages shall be brought into the Community Center.
(b) 
Smoking is prohibited in the Community Center.
(c) 
All events at the Community Center shall be properly supervised by a representative of the event or meeting. All activities involving minors must be properly chaperoned by adults at all times.
(d) 
Kitchen. The use of the cooking facilities of the Community Center shall not be permitted to the general public, and only qualified, trained and /or licensed individuals will be granted use of the cooking facilities. Limited use of the kitchen is permitted. Storage of food by any group or organization in the Community Center is prohibited.
(e) 
All events must conclude by 10:00 p.m. and, absent special permission, no event shall commence after 9:00 p.m.
(f) 
The organization or group hosting an event shall be responsible for the removal of materials, refuse, trash or debris at the conclusion of the event.
(g) 
Use of the Community Center may be withdrawn, denied or cancelled by the Borough for failure to comply with any of the provisions of this Section.
(h) 
Each organization or group hosting an event must obtain a fire prevention permit from the Eatontown Fire Prevention office prior to filing an application for use of the Community Center facilities.
(6) 
Application and fees. There will be an application and use fee of $25 which shall be submitted with any application for use of the Community Center facilities. The application shall be submitted to the Borough Clerk's office and shall be granted by the Business Administrator. The Business Administrator may rely on input provided by the Director of Recreation and Community Services. This is a nonrefundable fee which shall be waived only for official activities of the Borough, its boards, agencies, committees and departments and for the Borough youth and senior organizations. For all events, the applicant shall be required to identify the individual within the organization who is to be held responsible for the use of the facility and to ensure that the space is properly maintained and that all property belonging to the Borough is left intact and in proper working order.
(7) 
Insurance. A certificate of insurance giving evidence of public liability insurance coverage in the minimum amount of $1,000,000 shall be presented at the time application is made for use of the Community Center.
(8) 
Failure to comply with the provisions of this Subsection A may result in the imposition of a penalty in the amount of $200.
B. 
The following fees shall apply for activities at the Community Center, which fees shall be paid prior to the indicated activity:

A. 
A fee of $25 shall be charged to all persons being fingerprinted by the Borough of Eatontown or any of its agencies or subdivisions.
B. 
Those persons who are being fingerprinted in order to obtain solicitors' permits, taxi licenses, firearms permits or any other permits where fees are presently charged are exempted from this article and shall not pay an additional fee of $25.

Fee waiver: Application can be made to the Recreation Director or any official assigned by the governing body to supervise recreation programs in the Borough of Eatontown for a fee waiver after proof of financial hardship. Said fee waiver is not subject to appeal to any other municipal official or the governing body, and is final.

The Registrar shall issue, upon request, certified copies of birth certificates, death certificates and marriage licenses upon payment of a fee of $20 per certified copy. Uncertified copies of birth certificates, death certificates and marriage licenses shall be for a fee of $10. Filing of a correction form shall be for a fee of $10, initiating a correction form shall be for a fee of $30.

Persons seeking to be married or joined in civil union by the Mayor of the Borough of Eatontown shall pay a fee payable to the municipality in the amount of $75 for any ceremony performed within the Borough of Eatontown and $150 for any ceremony performed outside the Borough of Eatontown.

It shall be the policy of the Borough of Eatontown that the Mayor shall only be reimbursed for expenditures or expenses incurred as a result of the Mayor performing marriage or civil union ceremonies if approved by the Borough Council. The Borough shall reimburse only proper and reasonable expenses or expenditures incurred directly by or for the Mayor related to the officiating of a wedding or civil union. There shall be no reimbursement for parties involved other than the Mayor. The method of calculation and procedure for payment shall be the same as allowed and required of other employees of the Borough.

A. 
In accordance with N.J.S.A. 54:5-54, the Tax Collector shall provide, to any party entitled to redeem a certificate, two calculations of the amount required for redemption within a calendar year at no cost. For each subsequent calculation requested from the Tax Collector, there shall be a fee of $50. A request for a redemption calculation shall be made in writing to the Tax Collector.
B. 
In accordance with N.J.S.A. 54:5-97.1, the Tax Collector may charge a lienholder of a tax lien $50 for the calculation of the amount due to redeem the tax lien. Any request for a redemption calculation shall specify the date to be used for the calculation, which shall be the date of the notice. Neither the Tax Collector nor the municipality shall be liable for an incorrect calculation. The fee paid to the municipality shall not become part of the lien and shall not be passed on to any party entitled to redeem pursuant to N.J.S.A. 54:5-54.

Every landlord of a residential unit is required to register the property either with the Municipal Clerk or the Department of Community Affairs except that owner-occupied two-family properties are exempt. All single-family dwellings or two-dwelling units not owner-occupied that are rented require the landlord to register with the Municipal Clerk as required by N.J.S.A. 46:8-27 through 46:8-38 for each rental unit occupied with information required by statute and be charged a fee of $50 at the time of each new tenancy occupancy, with a copy of the registration statement provided by the landlord to each new tenant.

A. 
Use fee. There shall be a use fee for each applicant seeking use of a plot for gardening purposes at the community garden located at Husky Brook Park as follows:
(1) 
A use fee of $25 per gardening season for a garden plot of four feet by 20 feet per applicant.
(2) 
A use fee of $15 per gardening season for a garden plot of four feet by 10 feet per applicant.
(3) 
A use fee of $12.50 per gardening season for a garden aisle plot per applicant.

B. 
Application. Along with the use fee stated in Subsection A, the user of the community garden must complete an application approved by the Borough of Eatontown; said application of which, along with the appropriate fee, shall be submitted to the Borough Clerk's Office and shall be granted by the Borough Business Administrator. The Borough Business Administrator shall rely on input provided by the Advisory Committee on Sustainable Practices (Green Team) or other Committee designated by the Borough Council. All use fees are nonrefundable fees and nonassignable. The applicant shall be required to identify the individual who is to be held responsible for the use of the plot and that the community garden is left intact and in working order. The Borough shall also require, as part of the approval of the application, execution by the applicant of a waiver/hold harmless agreement approved by the Borough Attorney as a condition to use of the community garden.
C. 
Failure to comply with the provisions of Subsections A and B above shall result in revocation of the applicant's use of any assigned plots by the Borough Business Administrator.

A. 
In order to provide funds, in whole or in part, necessary to improve, maintain and police the parks, lands, playgrounds or recreation facilities; and to sponsor community-minded events, the Borough of Eatontown and its departments and/or committees may arrange and provide for the giving of exhibitions, events, concerts, games, contests, and other activities; and
B. 
The Borough may use and employ such parks, lands, playgrounds or recreation facilities for the purpose of giving thereon such exhibitions, concerts, games, events contests, and other activities; a fee schedule may be established of appropriate charges for said use.
C. 
The Borough Administrator may establish a schedule of reasonable fees to offset the costs of programs and activities it conducts for recreational or other events open to the Borough at large, unless provided elsewhere by ordinance.
