From and after the effective date of this chapter,
the Shade Tree Commission shall plant and maintain trees on each side
of every street in approved new subdivisions so as to provide at least
one tree for every 50 feet of street frontage. Said trees shall be
at least 1 1/2 inches to 1 3/4 inches in diameter and of
the following types: European or silver linden, London or oriental
plane; Norway, schwedler, sugar or red maple; red, pin, black, chestnut
or scarlet oak; sweet gum, honey locust; or such other equivalent
types as may be selected by the Commission.
Said trees shall be first-class nursery stock,
planted while in a dormant state, and with topsoil sufficient to cover
the roots. Said trees shall be in good growing condition at the end
of one year or shall be replaced by the original planter in accordance
with this chapter.

The Shade Tree Commission shall determine the
placement, planting and selection of trees in existing and new approved
subdivisions.
The Shade Tree Commission shall determine the
placement of said trees with due regard to the relation of the trees
to:
C. Size of lot.
as may be required in the particular subdivision.

The Shade Tree Commission shall determine the
selection of said trees with due regard to:
A. The soil condition in the area involved.
C. Prevention of spread of disease.

The cost of the Shade Tree Commission's plantings
shall be covered by funds appropriated in its annual budget; provided,
however, that the Commission's plantings made in subdivisions approved
after the effective date of this chapter shall be paid out of funds
provided by the owners or subdividers pursuant to Subsections 89.8.1.7
and 89.10.8.1L of the Eatontown Municipal Land Use Ordinance.

At its February and August meetings in each
year hereafter, the Shade Tree Commission shall, by resolution, calculate
and fix the amount per tree required to be paid by subdividers or
owners for the purchase and successful planting of trees as a condition
of obtaining approval of subdivisions.
