Following the appointment of citizens of the Town of Cortlandt to both the Planning Board and the Zoning Board of Appeals, the Town Board deems it to be appropriate that said new appointees be mandated to attend certain training courses so that they will better understand their roles and duties as members of their respective Boards. It is the intention of the Town Board to formally require this training and to provide for this training as required of all newly appointed members during the first two years of their term and also any reappointed member.
Any person who is appointed to the Planning Board or Zoning Board of Appeals for the Town of Cortlandt, following the effective date of this article, or any person who is reappointed to a new term shall be required to participate within the first two years of his term of office in a training course which would train him in the basic skills required in order for him to effectively and efficiently perform the duties of his office.
The Town Board of the Town of Cortlandt will from time to time adopt a resolution, pursuant to the authority of this article, designating the required training courses to be taken by all newly appointed members of the Planning Board and the Zoning Board of Appeals as set forth in § 77-11. The Town Board will from time to time update, supplement and change these training courses so as to provide a broad spectrum of background in subject matter and topics for which the new appointees must participate and train. The Town Board may further provide in said resolution that either mere attendance at those programs will be sufficient or, if the program is designed to have a test of competency following the same, that a passing grade must be obtained in order to continue service on the Planning Board or Zoning Board of Appeals.
Any member of the Planning Board or Zoning Board of Appeals appointed following the effective date of this article who shall fail to comply with the terms and conditions of this article within two years of his appointment will be subject to removal from said Board, following the procedures as set forth in §§ 267 and 271 of the Town Law of the State of New York. A person's failure to comply with the provisions of this article shall be deemed to be grounds for removal from his positions.
It shall be the duty of the newly appointed members of the Planning Board and Zoning Board of Appeals of the Town of Cortlandt to file with the Town Clerk his or her certification that said member of the Planning Board or Zoning Board of Appeals has complied with the provisions of this article. Said certification shall be filed on or before December 31 of each calendar year following the effective date of this article, and annually thereafter.
