The Town Board determines that it is appropriate that a fee be paid
upon the development of all residential units created in the Town of Cortlandt.
Previously, the recreation fee was only allowed with respect to newly created
lots. However, due to recent legislation adopted by the New York State Legislature
enacted into law by the State of New York, the Town Board is now authorized
to impose said recreation fee on any units of housing created by virtue of
special permits and/or site development plans. It is with this in mind that
the Town Board is desirous of imposing a recreation fee on all new units of
housing created within the Town.
There shall be imposed upon the creation of all residential units within
the Town a recreation fee in the sum of $6,000 per lot and unit, as created.
The method by which said units are created, either by subdivision, special
use permit or site plan approval, shall be irrelevant, and the fee shall be
due and payable for each and every residential unit created over and above
the first unit.
The fee imposed herein shall be the same as established pursuant to §
265-11 of the Town Code.
