This chapter is enacted in accordance with the provisions of Article 16 of the Town Law and in order to:
Promote and encourage the orderly and efficient development of the Town.
Assure the most appropriate use of land.
Help carry out the Master Plan.
Carry out the requirements of the Official Map.
Assure the Town of an adequate standard of improvements in new streets.
These regulations governing the subdivision of land in the Town of Cortlandt are hereby adopted by the Planning Board by authority delegated by ordinance of the Town Council July 27, 1954, as amended.*
*Editor's Note: The Town Board granted the following powers to the Planning Board by resolution:
On 7-27-1954, the Town Board resolved that the Town Planning Board of the Town of Cortlandt be and it hereby is authorized and empowered, pursuant to the provisions of §§ 276 and 281 of the Town Law, to approve plats showing such new streets or highways within that part of the Town outside of the limits of any incorporated city or village, and be it further resolved that the Town Clerk be and he hereby is instructed to immediately file with his certificate a certified copy of this resolution with the County Clerk of the County of Westchester.
On 1-17-1956, the Town Board resolved that whereas, under § 277 of the Town Law, entitled "Approval of Plats: Additional Requisite," the Planning Board, in its discretion, may provide, before the approval of a plat, that all streets or other public places shown on such plats shall be suitably graded and paved and that street signs, sidewalks, streetlighting standards, curbs, gutters, street trees, water mains, sanitary sewers and storm drains or combined sewers shall be installed, all in accordance with the standards, specifications and procedures of the appropriate Town departments, or, alternatively, that a performance bond sufficient to cover the full cost of the same, as estimated by the Planning Board, be furnished to the Town by the owner. Now, therefore, be it resolved that the Planning Board of the Town of Cortlandt is hereby granted all powers under § 277 of the Town Law in relation to additional requisite in approving plats.
On 4-7-1959, the Town Board resolved that the Planning Board of the Town of Cortlandt be and it hereby is given additional powers and controls as set forth under § 281 of the Town Law; said authorization being, in particular, with regard to the planned commercial and industrial development of the unincorporated areas of the Town of Cortlandt.

After the effective date of these regulations, no person, owner or agent shall convey, contract to convey or represent himself to be in a position to convey any lot, plot or parcel of land in the Town of Cortlandt resulting from any subdivision without the prior approval of the Planning Board pursuant to these regulations. The description of a lot, plot or parcel of land by metes and bounds in the instruments of transfer or other documents used in the process of selling or transferring shall not exempt the conveyance from the above prohibition.
The provisions of these regulations shall not apply to any map or subdivision plat approved by the Planning Board and filed with the County Clerk prior to the effective date of these regulations under § 276, Subdivision 5, of the local Zoning and Planning Law of the State of New York.[1]
