Editor's Note: Former Ch. 168, Environmental Quality Review, Art. I, General Provisions, adopted 5-9-1977 by L.L. No. 10-1977, as amended, was repealed 5-10-2010 by L.L. No. 13-2010. This local law also provided for the retention of the text of former Art. II and for the renaming of the chapter.
Consistent with Part 617 of Title 6 of New York Codes, Rules and Regulations (NYCRR) and the criteria therein listed, the following geographic areas are determined as critical areas of environmental concern by virtue of their exceptional and/or unique character:
A. 
Otter Creek.
(1) 
Beginning at a point on the southeasterly side of property known as the "Shore Acres Beach Club," said point being 450 feet northeast of the division line between the Towns of Rye and Mamaroneck; thence running in a northeasterly direction along and through the rear of properties fronting Alda Road a distance of 900 feet more or less to the northeasterly side of the South Barry Avenue Bridge over Otter Creek; thence running in a northerly direction more or less parallel to South Barry Avenue a distance of 200 feet; thence running in a northeasterly direction through the rear of properties fronting Soundview Drive 2,400 feet more or less to the point perpendicular to the southerly side of a dam on property now or formerly belonging to Samuel Magid; thence running in a southeasterly direction through said dam a distance of 100 feet; thence running in a southwesterly direction in the lands of Magid a distance of 400 feet; thence running in a southeasterly direction 300 feet more or less to a point 100 feet northwest of Taylor Lane; thence running in a southwesterly direction and parallel to Taylor Land a distance of 400 feet to the lands belonging to the Nature Conservancy; thence running along the division line between lands of the Nature Conservancy and lands of Magid in a southeasterly direction 100 feet to a point in the northwesterly side of Taylor Lane; thence running along the northwesterly side of Taylor Lane in a southerly direction a distance of 700 feet more or less to lands now or formerly belonging to Robert Purvin; thence running along the division line between lands of the Nature Conservancy and lands of Robert Purvin in a westerly direction a distance of 275 feet more or less; thence running along the division line of the Nature Conservancy and properties fronting Taylor Lane Extension in a southeasterly direction 800 feet more or less; thence running along the boundary line of the Nature Conservancy the following directions and distances more or less: northwesterly 135 feet, southwesterly 300 feet and northwesterly 610 feet to a point at the southeast corner of the South Barry Avenue Bridge over the Otter Creek; thence running in a southwesterly direction 100 feet; thence running in a southeasterly direction 200 feet; thence running in a southwesterly direction 600 feet more or less to a point 450 feet southwesterly of the division line between the Towns of Rye and Mamaroneck; thence running parallel to said division line in a northwesterly direction a distance of 300 feet to the point and place of beginning.
(2) 
Excluded from the above-described parcel is land now or formerly belonging to Janis Leventhal, known on Village of Mamaroneck Tax Maps as "Section 4, Block 77, Lot 21A."
(3) 
Said parcel contains approximately forty-two (42) acres.
(4) 
Said area of land includes all areas delineated as "tidal wetlands" as shown on the Tidal Wetlands Map, New York State Department of Environmental Conservation, Map No. 606-532, Index Map No. 2. Said parcel also contains all lands belonging to the Nature Conservancy, but excludes lands now or formerly of Leventhal.
(5) 
The designated area is also deemed to include adjacent area as defined in State of New York, Department of Environmental Conservation - Tidal Wetlands Land Use Regulations - Part 661, Section 661.4, Paragraph (b) and Paragraph (hh).
B. 
Guion Creek.
(1) 
Beginning at a point at the northeast corner of the South Barry Avenue Bridge over the Guion Creek; thence running in a northeasterly direction along the southerly boundary lines of properties fronting Guion Drive and Stuart Avenue a distance of 1,700 feet more or less; thence running in an easterly direction along the rear of properties fronting East Boston Post Road 450 feet more or less to the mouth of a culvert under East Boston Post Road; thence running in a westerly direction along the southerly bank of Guion Creek and into lands now or formerly the Village of Mamaroneck a distance of 900 feet more or less; thence running in the lands of the Village of Mamaroneck in a southerly direction a distance of 1,100 feet more or less; thence running in a westerly direction 200 feet more or less to the easterly side of South Barry Avenue; thence running along the east side of South Barry Avenue in a northerly direction 100 feet to the point and place of beginning.
(2) 
Said parcel contains approximately eleven (11) acres.
(3) 
Said area of land includes all areas delineated as "tidal wetlands" as shown on the map entitled "Tidal Wetlands Map, New York State Department of Environmental Conservation," Map No. 606-532, Index Map No. 2.
(4) 
The designated area is also deemed to include adjacent area as defined in State of New York Department of Environmental Conservation - Tidal Wetlands Land Use Regulations - Part 661, Section 661.4, Paragraphs (b) and (hh).
C. 
Magid Pond.
(1) 
Beginning at a point formed by the intersection of the westerly side of Taylor Lane with the southerly side of Soundview Drive (a paper street); thence running along said westerly side of Taylor Lane in a southerly direction a distance of 450 feet more or less to a point 50 feet northerly of the westerly boundary line of lands owned by Charles and Margaret Grimes, Jr.; thence running in a southwesterly direction on a line parallel to said boundary line of Grimes a distance of 300 feet; thence running in a westerly direction a distance of 400 feet more or less to the southerly side of an informal earthen dam; thence running in a northwesterly direction along said earthen dam and through Soundview Drive a distance of 100 feet; thence running parallel to Soundview Drive in a northerly direction a distance of 300 feet more or less to the northerly side of Garden Road (a paper street); thence running along said side of Garden Road in a westerly direction a distance of 200 feet more or less to the southerly side of Soundview Drive; thence running along said side of Soundview Drive in a northerly direction a distance of 550 feet more or less to the point or place of beginning.
(2) 
Said parcel contains approximately five (5) acres.
(3) 
Said parcel includes all lands designated as "freshwater wetlands" as shown on the map entitled "Tentative Freshwater Wetlands Map," and prepared by New York State Department of Environmental Conservation.
(4) 
The designated area is also deemed to include adjacent area as defined in State of New York Department of Environmental Conservation, Freshwater Wetlands Maps and Classification Regulations, 6 NYCRR 664.2(b).
D. 
Van Amringe Mill Pond.
(1) 
Beginning at a point on the northerly side of the westerly end of the Van Amringe Mill Pond Dam; thence running in a northerly direction along a strip of land between the Van Amringe Mill Pond and Taylor Lane a distance of 800 feet more or less; thence running along the southeasterly side of lands fronting Taylor Lane the following directions and distances: easterly 250 feet more or less, northerly 150 feet more or less, northwesterly 350 feet more or less, northeasterly 450 feet more or less, easterly 400 feet more or less and northeasterly 250 feet more or less to the rear of properties fronting Barrymore Lane; thence running along the rear line of properties fronting Barrymore Lane in a northeasterly direction 300 feet more or less to the division line between the Village of Mamaroneck and City of Rye; thence running along said division line and along the rear of properties fronting Lake Road and Shore Road the following directions and distances: southerly 400 feet more or less, southwesterly 250 feet more or less, southeasterly 400 feet more or less, southerly 400 feet more or less, northwesterly 450 feet more or less and southeasterly 1,500 feet more or less to the easterly side of a Causeway; thence running along the northerly side of said Causeway and in a northwesterly direction a distance of 300 feet more or less to the point and place of beginning.
(2) 
Excluded from the above parcel of land is an island known as Bion Island (Section 4, Block 77A, Lots 22A and 23B).
(3) 
Said parcel contains approximately twenty-five (25) acres.
(4) 
Said area of land includes all areas delineated as "tidal wetlands" as shown on the map entitled "Tidal Wetlands Map, New York State Department of Environmental Conservation," Map No. 606-532, Index Map No. 2.
(5) 
The designated area is also deemed to include adjacent area as defined in State of New York, Department of Environmental Conservation - Tidal Wetlands Land Use Regulations - Part 661, Section 661.4, Paragraph (b) and Paragraph (hh).
E. 
Mamaroneck Reservoir.
(1) 
Beginning at a point on the center line of the easterly side of the Mamaroneck Avenue Bridge over the Mamaroneck Reservoir; thence running in an easterly direction along the division line between the Towns of Harrison and Mamaroneck a distance of 900 feet more or less to the westerly side of a dam; thence running along the westerly side of said dam and continuing through to the northerly side of Mamaroneck Avenue in a southerly direction a distance of 300 feet more or less; thence running along the northerly side of Mamaroneck Avenue in a westerly and northwesterly direction a distance of 600 feet more or less to the point and place of beginning.
(2) 
Said parcel contains approximately three and five-tenths (3.5) acres.
F. 
Hampshire Country Club.

(1) 
Beginning at a point formed by the intersection of the southerly side of Eagle Knolls Road with the division line between the Village of Mamaroneck and Town of Mamaroneck; thence running along said division line in a northerly direction a distance of 950 feet more or less to the southeasterly property line of lands known as "Fairway Green;" thence running along said boundary line of Fairway Green in an easterly direction a distance of 1,200 feet more or less to the westerly side of properties fronting Old Post Lane; thence running along said westerly side of properties fronting Old Post Lane in a southerly direction a distance of 250 feet more or less; thence running along the southerly side of properties fronting Old Post Lane in an easterly direction a distance of 200 feet more or less; thence running along the easterly side of a property fronting Old Post Lane in a northerly direction a distance of 150 feet more or less; thence running along the southerly side of property fronting Cooper Avenue and the southerly side of Cooper Avenue in an easterly direction a distance of 180 feet more or less; thence running along the westerly side of properties fronting Protano and Sylvan Lanes in a southerly direction 800 feet more or less; thence running along the southerly side of properties fronting Sylvan Lane in an easterly direction a distance of 700 feet more or less; thence running in a southerly direction along the westerly side of properties fronting Orienta Avenue, Fairway Lane, Cove Road and the westerly side of Cove Road a distance of 1,500 feet more or less; thence running along the northerly and westerly sides of a property fronting Cove Road in a westerly and southerly direction distances of 350 feet and 250 feet more or less to the southerly side of Cove Road North; thence running along the southerly side of Cove Road North in a westerly direction a distance of 100 feet more or less; thence running along the westerly side of a property fronting Cove Road North in a southerly direction a distance of 200 feet more or less to the southerly side of Cove Road South; thence running in a southwesterly direction along said side of Cove Road South and along the northwesterly side of property fronting said Cove Road South a distance of 700 feet to the northerly side of Delancey Cove; thence running in a westerly direction along the northerly sides of Delancey Cove and property fronting Hommocks Road a distance of 1,300 feet more or less to the easterly side of Hommocks Road; thence running along said side of Hommocks Road in a northerly direction a distance of 550 feet more or less to the southerly side of property fronting Hommocks Road; thence running in an easterly direction along the southerly side of properties fronting Hommocks Road and Eagle Knolls Road a distance of 600 feet more or less to the southerly side of said Eagle Knolls Road; thence running along said southerly side of Eagle Knolls Road in a northwesterly direction a distance of 700 feet more or less to the point and place of beginning.
(2) 
Said parcel contains approximately one hundred (100) acres.
(3) 
Said parcel is now or formerly owned by Estate Appraisal and Valuation Company, Inc.
(4) 
Said parcel is also known as "Section 9; Block 72, Lots 1, 2, 3, 11, 15, 16, 17B, 17C, 18D, 24, 25, 28, 29; Block 89B, Lots 15 and 16; Block 89C, Lots 22A and 23; Block 89D, Lots 24-28 inclusive," on the Tax Map of the Village of Mamaroneck.
G. 
Hommocks Conservation Area (Village of Mamaroneck portion).

(1) 
Beginning at a point formed by the intersection of the southerly side of Hommocks Road with the division line between the Village of Mamaroneck and the Town of Mamaroneck; thence running along said boundary line in a southerly direction a distance of 1,050 feet more or less to the northerly side of New Hommocks Road; thence running along the northerly side of New Hommocks Road in a northeasterly direction to the southerly side of Hommocks Road a distance of 290 feet more or less; thence running along the southerly side of Hommocks Road a distance of 800 feet more or less to the point and place of beginning.
(2) 
Said parcel is also known as "Section 9, Block 92, Plot, and Lot 1B."
