No person shall willfully give or cause to be given a false alarm of fire within the Village of Ocean Beach.[1]

No person, other than a police officer or peace officer while in the performance of his duties, shall fire or discharge any gun or firearm in the Village of Ocean Beach. No person shall be in possession of or discharge or light any fireworks in the Village of Ocean Beach.

No person shall set fire to, burn or cause to be set fire to or burned in the Village of Ocean Beach any waste, paper, grease, wood, hay, straw, rubbish or flammable material outside a fireplace or stove.

No person shall build a bonfire at any place within the Village of Ocean Beach.[1]

No person shall interfere with, obstruct or limit the work or operation of the Fire Department at the time of any fire in the Village of Ocean Beach or ride on any fire trucks, tanks or engines of the Fire Department of the village at the time of a fire unless authorized to do so by the Fire Department or obstruct the sidewalks or public places so as to interfere with their free use and access by the fire-fighting equipment of the village or willfully neglect or refuse to obey, or attempt to prevent or obstruct, the execution of the orders of the officers of the Fire Department at such times or at any time when the Fire Department is operating or acting in a performance of its duties.

A. 
No person shall use or allow to be used any open flame, burning candle or candles in any public building or place of public assemblage, such as restaurants, bars, schools, stores, movie theaters and association halls or in connection with any public meeting or gathering, except in compliance with the following requirements and after approval of the Chief of the Fire Department:
(1) 
Except for uses specified in Subsection A(2) herein:
(a) 
The diameter of the base of the holder must be at least 1/2 the height of the candle or candleholder.
(b) 
The base of the holder must support the candle on its entire perimeter.
(c) 
The candle and flame must be substantially enclosed.
(d) 
Any shade or similar device must be securely affixed to the candleholder and must be totally composed of fire-resistant materials.
(e) 
The candleholder must be securely attached to its base.
(f) 
The candle must be secured in its holder so that it will not easily separate if dropped.
(g) 
The candle must be located in the holder so that there is a minimum of two inches between the top of the flame and any combustible material that might be placed on top of the holder.
(h) 
All materials except the candle itself shall be noncombustible.
(2) 
Candles used in connection with religious ceremonies.
(a) 
Candles used in places of worship shall be limited to areas out of the reach or way of occupants using the area.
(b) 
Candelabra shall be located away from occupants using the area and away from possible contact with drapes, curtains and other combustibles.
B. 
Installation of spark arresters. Every chimney or flue connected to any incinerator of whatsoever kind, nature or description hereafter placed or erected or used in any building of any kind, nature or description in the Village of Ocean Beach shall be equipped with a suitable screened spark arrester consistent with the New York State Building and Fire Codes. Within 30 days from the effective date of this subsection, all chimneys and flues for all buildings of whatsoever kind or description then in existence in the Village of Ocean Beach shall be equipped with a suitable screened spark arrester of a type approved by the New York State Building and Fire Codes. It shall be the duty of the Fire Inspector of the Village of Ocean Beach to make annual inspections of all chimneys and flues of all buildings within the Village of Ocean Beach for the purpose of approving or disapproving all spark arresters.

C. 
This section shall not apply to the use of electric, propane gas grill or barbecue as provided in § 87-13 of this Code.

No person shall use or cause or permit others to use garden hoses, sprinklers or other appliances requiring the use of water supplied by the Village of Ocean Beach outside of any building for irrigation, gardening, cleaning or any other purpose, except for necessary municipal purposes, during any of the hours beginning at 7:00 p.m. on Friday and ending at 7:00 p.m. on the following Sunday between June 15 and September 15 in any year or at any other time during periods of drought or water shortage.

All property owners with structures on their property shall display on said property the designated lot number for such property in Arabic, clearly visible from the public walk adjacent to said property. Said number shall be not less than three inches in height nor more than six inches in height. Said amendment shall be effective on and after May 1, 1973.

All property owners shall install and tenants or other persons using or occupying any structure for residential purposes within the Incorporated Village of Ocean Beach shall maintain at least one Underwriter-approved extinguisher (fully charged ABC type) of at least two and one-half (2 1/2) pounds' capacity which shall be replaced or recharged annually.

All property owners shall install and tenants or other persons using or occupying any structure for residential purposes within the Incorporated Village of Ocean Beach shall maintain at least one Underwriter-approved smoke detector on each floor of any structure located on the property and shall maintain the same in good working order.

All property owners shall install and tenants or other persons using or occupying any structure for residential purposes within the Incorporated Village of Ocean Beach at all times when the water supply is turned on shall maintain at least one faucet, spigot or other device whereby running water is exited or allowed to flow from a pipe which shall be regulated as to flow from the exterior of the building and which shall be in working order at all times and connected to a minimum of 100 feet of garden-type hose in good condition, equipped with a pressure nozzle, which shall be easily accessible on the outside of any structure so as to permit access in the event that the aforesaid hose need be utilized in the event of fire.

Proof of compliance with §§ 87-9, 87-10 and 87-11 hereof shall be filed annually on or before June 1 of each and every year with the Village Clerk of the Incorporated Village of Ocean Beach on a form of certificate as may be prescribed by the Board of Trustees and shall be reviewed by the Fire Chief of the Incorporated Village of Ocean Beach whose responsibility it shall be to ensure compliance with same.

A. 
No person shall light a fire, use an electric, gas, charcoal or other heat source for outdoor cooking or in any other manner cook outdoors in the Village of Ocean Beach except as provided herein and only with respect to noncommercial property.
B. 
Subject to the rules and regulations as adopted by the Board of Trustees from time to time and upon the issuance of a permit by the Fire Marshal, the use of an electric or propane gas grill or barbecue as a heat source for outdoor cooking shall be permitted in the Village of Ocean Beach.
C. 
The Fire Marshal shall have the authority to issue a summons, to refuse to permit, to revoke the permit issued to any person or to confiscate the grill, barbecue or heat source that does not or fails to maintain the conditions required in this section or the rules and regulations promulgated in accordance with this section. A violation of this section or any rule and regulation promulgated in accordance with this section shall constitute a violation punishable by a fine of not to exceed $250 or imprisonment not to exceed 15 days.

Any person violating any of the provisions of this Article shall be subject, upon conviction, to the penalties set forth in Chapter 1, General Provisions, § 1-14.
