No person or persons, firm, corporation, partnership or association
shall set or maintain any fire upon any of the streets, sidewalks, alleys
or public grounds in the Township of North Codorus for the purpose of burning
or causing to be burned any papers, boxes, rubbish, leaves, trash, garbage,
refuse or other material or substance of any kind.
No out-of-door fires or open burning shall be permitted upon private
property in North Codorus Township unless the following regulations and restrictions,
which are hereby established, are strictly adhered to:
A. No open burning shall be allowed except on Saturday between
the hours of 7:00 a.m. and 4:00 p.m. Burning in suitable enclosed containers
is permitted Monday through Saturday between the hours of 7:00 a.m. and 4:00
p.m.
B. No fires or open burning are permitted within 100 feet
of any dwelling except that burning shall not be permitted within 50 feet
of any dwelling, which shall include adjacent dwellings, provided that the
burning is contained in a suitable enclosed container.
C. Stumps and brush and farm debris may be burned by farmers
and other workmen, who are adults, only if the adult remains and closely supervises
the burning at all times. Said burning may be conducted Monday through Saturday
between the hours of 7:00 a.m. and 4:00 p.m.
D. Use of outdoor fireplaces or other devices for the purpose of preparing food is permitted, and Subsections
A,
B and
C of this section do not apply to such fires.
North Codorus Township reserves the right to ban all burning, provided
that the Township advertises said intent to ban burning at least one time
prior to the effective date of said ban.

Except as may be otherwise provided by 35 P.S. § 4001 et seq.,
any person who violates or permits a violation of this chapter shall, upon
conviction in a summary proceeding brought before a District Justice under
the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense
and shall be punishable by a fine of not more than $1,000, plus costs of prosecution.
In default of payment thereof, the defendant may be sentenced to imprisonment
for a term not exceeding 90 days. Each day or portion thereof that such violation
continues or is permitted to continue shall constitute a separate offense,
and each section of this chapter that is violated shall also constitute a
separate offense.
