This chapter should be known and may be cited as "The North Codorus Township Zoning Ordinance."
A. 
This chapter is enacted under the authority and procedures of the Pennsylvania Municipalities Planning Code (MPC), as amended, and serves the purposes of such law.
B. 
Applicability. This chapter requires that, within North Codorus Township, York County, Pennsylvania, no land, body of water, or structure shall hereafter be used or occupied and no structure or part thereof shall hereafter be erected, constructed, reconstructed, moved or structurally altered, unless in conformity with all the regulations and procedures herein specified for the district in which such land, body of water, or structure is located.
A. 
General purposes. This chapter is designed to meet the following general purposes. To promote, protect and facilitate any or all of the following:
(1) 
Protect the public health and safety and serve the general welfare;
(2) 
Provide coordinated and practical community development and proper density of populations;
(3) 
Support emergency management preparedness and operations;
(4) 
Provide adequate light and air, access to incident solar energy, vehicle parking and loading space, transportation, sewerage, recreational facilities, the provision of a safe, reliable and adequate water supply for domestic, commercial, agricultural or industrial use, and other public requirements, and to promote use of wind energy;
(5) 
Preserve the natural, scenic and historic values in the environment and preserve forests, wetlands, aquifers and floodplains;
(6) 
Prevent one or more of the following: overcrowding of land, blight, danger and congestion in travel and transportation, loss of health, life or property from fire, flood, panic or other dangers;
(7) 
Maintain agricultural activities and preserve farmland;
(8) 
Provide for the use of land within the municipality for residential housing of various dwelling types encompassing all basic forms of housing;
(9) 
Accommodate reasonable overall community growth, including population and employment growth, and opportunities for development of a variety of residential dwelling types and nonresidential uses; and
(10) 
Serve other purposes that are authorized by the MPC.
B. 
This chapter provides the legal basis and framework for the future development and redevelopment of the Township. Its provisions are guided by the statement of community development goals and objectives and the policy and action plans of the North Codorus Township Comprehensive Plan and Plan documents of the York County Planning Commission.
It is hereby declared to be the legislative intent that if a court of competent jurisdiction declares any provisions of this chapter to be invalid or ineffective in whole or in part, the effect of such decision shall be limited to those provisions which are expressly stated in the decision to be invalid or ineffective, and all other provisions of this chapter shall continue to be separately and fully effective. The Board of Supervisors hereby declares that it would have passed this chapter and each section or part thereof, other than any part declared invalid, if it had advance knowledge that any part would be declared invalid. If the entire Zoning chapter should be declared invalid, then the North Codorus Township Zoning Ordinance that was in effect immediately prior to the enactment of this new Zoning chapter shall automatically be reinstated as the Zoning Ordinance for North Codorus Township.
The preexisting North Codorus Township Zoning Ordinance, as amended, is hereby repealed, in addition to the repeal of any other Township ordinances or resolutions or parts thereof that were adopted prior to this chapter that are clearly in direct conflict with this chapter.
Under the authority conferred by the Pennsylvania Municipalities Planning Code, as amended, the Board of Supervisors of North Codorus Township hereby enacts and ordains into an Ordinance the attached document this 17th of February, 2015. This chapter shall become effective in five calendar days.
