[HISTORY: Adopted by the Town Council of
the Town of Westerly 2-8-2010 by Ord. No. 1701. Amendments noted where

The proposed plan entitled "Town of Westerly,
Comprehensive Plan," dated December 2009, consisting of three
components: (1) the Plan itself; (2) Appendices I and II; and (3)
Executive Summary, and those amendments adopted by the Town Council
at its meeting on February 8, 2010, is hereby adopted and enacted
in accordance with the provisions of RIGL 45-22.2, entitled "Rhode
Island Comprehensive Planning and Land Use Regulation Act,"
as the Town of Westerly Comprehensive Plan.
All previous Comprehensive Plans are repealed
upon adoption of the December 2009 Plan pursuant to RIGL 45-22.2-8(c);[1] provided, however, that insofar as it replaces and/or
amends the prior Comprehensive Plan of the Town of Westerly, it shall
become effective for the purposes of guiding state agency actions
when it is approved by the State of Rhode Island in the manner set
forth in RIGL 45-22.2.

Editor's Note: This ordinance (Ch. No. 1701) repealed former
Ch. 10, Comprehensive Plan, was adopted 8-13-1991 by Ch. No. 983 as
§§ 10-91 through 10-95 of the 1991 Code, as amended.
Additions or amendments to the Plan when passed
in the form as to indicate the intention of the Town Council to make
the same a part of the Plan shall be deemed to be incorporated in
the Plan, so that reference to the Plan includes the additions and
amendments.
A copy of such Comprehensive Plan shall be kept
on file in the office of the Town Clerk, preserved in a form as the
Town Council may consider most expedient. It shall be the express
duty of the Town Clerk, or someone authorized by said Clerk, to insert
in their designated place all additions or amendments to said plan
when the same have been enacted and printed or reprinted in page form
and to extract from such plan all provisions which from time to time
may be repealed by the Town Council. This copy of such Plan shall
be available for all persons desiring to examine the same.
It shall be unlawful for any person to change or alter by additions or deletions, any part or portions of such Plan, or to insert or delete pages or portions thereof, or to alter or tamper with such Plan in any manner whatsoever which will cause the Plan to be misrepresented thereby. Any person violating this section shall be punished as provided in § 1-22 of the Code of the Town of Westerly, Rhode Island.
This chapter shall become effective upon passage pursuant to
RIGL 45-22.2-8(c); provided, however, that insofar as it amends and/or
replaces the prior Comprehensive Plan of the Town of Westerly, it
shall not become effective for purposes of guiding state agency actions
until it is approved by the State of Rhode Island in the manner set
forth in RIGL 45-22.2.
