The purpose of this chapter is as follows: to
protect public safety and regulate motor vehicles in the Town of Fulton.
The Town Board of the Town of Fulton has the
specific statutory authority, powers and duties, pursuant to the specific
statutory sections noted in this chapter and/or by its adoption of
village powers under § 60.10, Wis. Stats., to regulate,
control, prevent and enforce against in the Town of Fulton certain
uses, activities, businesses and operations by persons that may affect
the traffic in the Town of Fulton.
The Town Board of the Town of Fulton has, by
adoption of this chapter, confirmed the specific statutory authority,
powers and duties noted in the specific sections of this chapter and
has established, by these sections and this chapter, the regulations,
controls and enforcement against certain uses, activities, businesses
and operations by persons that may affect the traffic in the Town
of Fulton.
Except as specifically noted otherwise in this
chapter, Chs. 340 to 348, Wis. Stats., inclusive, and Chs. 350 and
941, Wis. Stats., describing and defining regulations with respect
to vehicles, traffic and snowmobiles, for which the penalty is a forfeiture
only, including penalties to be imposed and procedure for prosecution,
are hereby adopted and incorporated by reference by the Town of Fulton
and made part of this chapter as if fully set forth herein. Any future
amendments, modifications, revisions, additions or deletions of the
above-noted statutory chapters shall be incorporated herein and made
part of this chapter in order to secure uniform state regulation of
traffic on the public highways, roads, streets and alleys of the State
of Wisconsin.

The Town Board has determined that the statutory speed limits
on the following roads, streets and highways are unreasonable, unsafe
and imprudent and so modifies such speed limits as follows:

A.
No person shall cause, allow or permit any person
to operate or maintain a motorbike, motorcycle, minibike, all-terrain
vehicles, go-cart, trail bike or snowmobile in the Town of Fulton:
B.
The following are regulations established by the Town
Board of the Town of Fulton to regulate snowmobiles in the Town of
Fulton:[1]
(1)
No person shall violate § 350.10, Wis. Stats.,
as amended, such being incorporated by reference herein.
(2)
No snowmobile shall be operated within the right-of-way of any Town road, alley or public way unless permitted by the Town of Fulton, in writing, except as set forth in Subsection B(3).
(3)
The following snowmobile routes are hereby created
and shall be commonly known as those portions of County Trunk Highway
"M" and County Trunk Highway "F" lying within the limits of the unincorporated
Village of Indianford, Town of Fulton, as a part of the Town of Fulton
snowmobile route extending from the intersection above the existing
Rock County Snowmobile Trail with County Trunk Highway "F" at the
southerly limit of said unincorporated village on the east side of
the Rock River, through the intersection of County Trunk Highway "F"
with the Rock County Snowmobile Trail to the north of the unincorporated
Village of Indianford, on the westerly side of the Rock River.

Relative to the use of the above-described snowmobile
routes, no person shall do any of the following:

The Town Board of the Town of Fulton, or the Town
of Fulton Chair, or Town of Fulton Police Chief, if reasonably required
to protect health, safety or property, may temporarily, by written
order, suspend the use of any or all of the above-described snowmobile
routes. Such order shall be posted at the Town of Fulton Town Hall,
and a copy may be mailed to an officer, director or shareholder of
any snowmobile club believed to be using such trail, and a copy shall
be affixed to at least one route sign. Use of the route after such
suspension of use shall constitute a violation of this section.

B.
Noncompliance prohibited. No person shall operate or allow to be operated on any highway, street or alley within the Town a vehicle that is not in conformity with the requirements of Subsection A or the provisions of § 110.075 and Ch. 347, Wis. Stats., incorporated by reference in § 410-4 of this chapter.
C.
Safety checks.
(1)
Operators to submit to inspection. When directed to
do so by any law enforcement officer, the operator of any motor vehicle
shall stop and submit such vehicle to an inspection and such tests
as are necessary to determine whether the vehicle meets the requirements
of this section or that the vehicle's equipment is in proper adjustment
or repair. No person, when operating a motor vehicle, shall fail to
stop and submit such vehicle to inspection when directed to do so
by any law enforcement officer as herein provided.
(2)
Authority of officer. Any law enforcement officer
of the Town is hereby empowered, whenever he or she shall have reason
to believe that any provision of this section is being violated, to
order the operator of the vehicle to stop and to submit such vehicle
to an inspection with respect to brakes, lights, turn signals, steering,
horns and warning devices, glass, mirrors, exhaust systems, windshield
wipers, tires and other items of equipment.
(3)
Vehicle to be removed from highway. Whenever, after
inspection as provided by this section, a law enforcement officer
determines that a vehicle is unsafe for operation, he or she may order
it removed from the highway and not operated, except for purposes
of removal and repair, until the vehicle has been repaired as directed
in a repair order. Repair orders may be in the form prescribed by
the Secretary of the Department of Transportation under § 110.075(5),
Wis. Stats., and shall require the vehicle owner or operator to cause
the repairs to be made and return evidence of compliance with the
repair order to the department of the issuing officer within the time
specified in the order.

The authority of the Town to prohibit, limit
the time of or otherwise restrict the stopping, standing or parking
of vehicles beyond the prohibitions, limitations or restrictions imposed
by Ch. 346, Wis. Stats., pursuant to the provisions of § 349.13(1e),
Wis. Stats., is hereby incorporated herein, except that the Town shall
not modify the exceptions set forth in § 346.50, Wis. Stats.
Such regulations shall be established by resolution of the Town Board
of the Town of Fulton and shall be enforced pursuant to the provisions
of this chapter.
The Town of Fulton establishes by this chapter that the enforcement of traffic ordinances in the Town of Fulton and the penalties for violation shall be in accordance with §§ 66.0114 and 345.53, Wis. Stats., and Chapter 20, Citations, of this Code. A stipulation shall conform to the form contained in the uniform traffic citation and may be accepted within 21 days of the alleged violations as set forth in Chapter 20. Stipulations and deposits may be accepted by the Town Clerk/Treasurer of the Town of Fulton. Deposits shall be made in conformance with § 345.26, Wis. Stats., and Chapter 20. If a particular deposit is not established by § 345.26, Wis. Stats., then the person shall deposit as provided by the Town of Fulton and approved by the Town Board of the Town of Fulton.
