[Amended 11-16-2005 by L.L. No. 2-2005; 11-18-2010 by L.L. No. 5-2010; 11-16-2017 by L.L. No. 22-2017]
A. No person or persons shall be permitted to engage
in or carry on the trade, business or calling of employing plumbers,
or as master of plumbers in the Village of Island Park, unless such
person or persons shall have secured a license from the Village Clerk
of said Village upon the payment of a fee as set from time to time
by the Board of Trustees to cover the cost of the license.
B. The license may be renewed each year upon payment
of a renewal fee as set from time to time by the Board of Trustees,
along with the necessary insurance and workers' compensation requirements.
C. All plumbing
fixtures, gas conversions, and applications to maintain existing fixtures
will require a plumbing permit along with payment of the associated
fees as per the schedule set from time to time by the Board of Trustees.
D. These fees
are subject to change by resolution of the Board of Trustees.
Any person or persons so employing plumbers
or master plumbers carrying on their trade, business or occupation
as plumber in the Village of Island Park shall apply for such license
prior to any plumbing work to be doing in said Village. The license
fee, as set forth in this chapter, shall be for a period of one year
ending December 31 of each year thereof. Such registration may be
canceled by the Board of Trustees of this Village for a violation
of the rules and regulations for plumbing or plumbing installation
as may be adopted by said Board of Trustees for said Village or in
force at the time of the enactment of this chapter. Such cancellation
shall be upon notice to the registrant of not less than 10 days prior
to any hearing to be held by the Board of Trustees.
All plumbing, installations, alterations or
repairs hereafter made, installed, altered or repaired in the Village
of Island Park shall be in conformity with the Plumbing Code of the
State of New York and any amendments thereto.
Every plumber shall file with the Village Clerk
before beginning operations under his license, and upon each renewal
of said license, a policy of liability insurance, issued by an insurance
company licensed to do business in the State of New York, and which
is approved by said Village Clerk, insuring, indemnifying and saving
harmless the Village of Island Park of and from all damages or claims
for damage to a public sewer, water service mains or pipes, to a highway
or the surface thereof, to public or private property or to any person
arising from unlawful or negligent acts or omissions of said plumber,
his agents or employees, or any person operating under the authority
of his license, in making connection with a public sewer; in opening
a public sewer; or in making an opening or excavation in a public
highway, public square or public park or in maintaining, guarding,
refilling, or working in or about such opening or excavation or in
maintaining or guarding objects or materials taken from such opening
or excavation or used in connection therewith. Each such policy of
liability insurance shall provide against loss from the liability
imposed by law for damages, including damages for care and loss of
services, because of bodily injury to or death of any person and injury
to or destruction of property arising out of the aforesaid activities
of such plumber, subject to a limit, exclusive of interests and costs,
of $300,000 because of bodily injuries to and/or death of person or
persons in any one action, and of $50,000 because of injury to or
destruction of property of others, including the Village. Every plumber
shall also file with the Village Clerk, in a form acceptable to said
Clerk, proof that he has in force and in effect insurance required
under the Workers Compensation Law.
Every person found guilty of violating any of
the provisions hereof shall, upon conviction thereof, be liable to
be punished by a fine of not less than $50 nor more than $250 or to
imprisonment for not more than 15 days, or to both such fine and imprisonment
in the discretion of the court.
