For the purpose of this article:
TRAP
Any device, structure, material, or combination thereof, or any hole in the ground:
A. 
Which is placed or situated in an area that is outdoors or otherwise accessible to cats; and
B. 
Which is hidden or which contains features or includes any item capable of inducing or luring a cat into approaching, coming in contact with or ingesting it; and
C. 
Which, by such contact, approach or ingestion, would cause the cat to be killed, injured, poisoned, incapacitated, confined or otherwise exposed to, or positioned for, an external attack.
A. 
It shall be unlawful anywhere in the Village of Atlantic Beach for any person to:
(1) 
Intentionally kill, injure or torture a cat; or
(2) 
Trap or confine a cat in any cage or containment structure; or
(3) 
Set a trap for the purpose of confining a cat in any cage or containment structure; or
(4) 
Be the owner or person in control of real property upon which a trap is set for the purpose of confining a cat in any cage or containment structure.
B. 
The above proscriptions shall not apply to:
(1) 
Any humanely conducted act of temporarily confining a cat in an appropriate cage or containment structure undertaken by the owner of the cat; or
(2) 
Any humanely conducted act of euthanizing, trapping or confining a cat by or under the supervision of a licensed veterinarian or a society for prevention of cruelty to animals or similar organization undertaken with the consent of the owner or, if no owner is ascertainable after due diligence, with the written consent of the Village Clerk.
A. 
Any person who shall commit an offense against § 52-17A(1) hereinabove shall be subject to a fine of not less than $50 nor more than $250 for each cat intentionally killed, injured or tortured.
B. 
Any person who shall commit an offense against § 52-17A(2) and/or (4) hereinabove shall be subject to a fine of not less than $50 nor more than $250 for each cat so trapped or confined in any cage or containment structure.
C. 
Any person who shall commit any offense against § 52-17A(3) and/or (4) hereinabove shall be subject to a fine of not less than $50 nor more than $250 for each trap set for the purpose of confining a cat in any cage or containment structure.
This article shall be enforceable by Village Code Enforcement Officers, by the Nassau County Police, by any peace officer acting in accord with his or her special duties, or by any authorized official of the Town of Hempstead or the County of Nassau.
