There is hereby established a Zoning Plan for
the Town of Neversink which plan is set forth in the text, Schedule
of District Regulations and Zoning Map that constitute this chapter.

It is the legislative purpose of this Zoning
Law to provide for the orderly and desirable development and use of
land in accordance with authority granted to towns in §§ 261
through 266 of the New York State Town Law. This chapter is, moreover,
intended to promote the public health, safety and welfare by meeting
the goals, objectives and recommendations set forth in the Town of
Neversink Comprehensive Plan and effectuate the Comprehensive Plan.
Accordingly, in furtherance of such intention, this chapter shall
supercede, in part, in their application to the Town of Neversink,
the provisions of the aforesaid sections of the New York State Town
Law. Specifically, this chapter is intended to carry out, but not
be limited to, the following objectives:
A. To provide for the public health and safety of Town
residents.
B. To encourage the availability of clean water and proper
sewage disposal within the Town.
C. To maintain and protect the rural character of the
Town.
D. To strongly encourage the protection of agricultural
resources.
E. To protect the natural amenities and environmentally
sensitive areas of the Town.
F. To prevent excessively dense and inefficiently spaced
development.
G. To prevent overcrowding of structures.
H. To protect and enhance the historic structures and
sites of the Town.
I. To discourage nuisances and harmful and unsightly
uses.
J. To protect the community against unsightly and obtrusive
land uses and operations.
