No auction or public sale shall be held in the
Village of Island Park without compliance with the following conditions:
A. An application for a permit must be submitted to the
Board of Trustees of the Village in writing at least 30 days prior
to the holding of any such sale by the owner or owners of the personal
property to be sold.
B. The cost of such permit shall be as prescribed by
the Board of Trustees from time to time for the holding of an auction
sale and for the holding of a public sale other than an auction sale,
including the day of inspection, if any.

C. No sale shall be held for more than two consecutive
days, nor shall there be more than one day of inspection. The day
or days of sale and/or inspection shall be limited to the hours from
10:00 a.m. to 4:00 p.m.
D. The size and number of signs shall comply with Chapter
625, Zoning, §
625-9, or as otherwise prescribed by the Board of Trustees. They shall not be erected before the date of inspection, if any, or the first day of the sale and shall be removed by no later than 6:00 p.m. on the last day of the sale.
E. There shall be no loudspeakers permitted other than
a single loudspeaker for purposes of conducting an auction sale and
the volume thereof shall not reach beyond the audience.
F. The sale of any property by auction or public sale
shall be limited solely to property owned by the resident-applicant.
G. A public sale other than an auction sale on any given
premises may be held no more often than twice every year.
H. An auction sale shall be held no more than once by
any individual during the period of his ownership of the real property
on which the sale is located.
As used in this chapter, the following terms
shall have the meanings indicated:
AUCTION SALE
Any public sale of property, whether real or personal, to
the person offering the highest price.
PUBLIC SALE
Includes sales presently referred to as "garage sales."
Every permittee conducting any sale hereunder
shall keep the Village permit displayed in a conspicuous place at
the place of sale or on such vehicle used in such business.
Any person committing an offense against this
chapter shall be guilty of a violation punishable by a fine not exceeding
$250 or by imprisonment for a period not exceeding 15 days for each
offense, or by both such fine and imprisonment. Each day of any sale
not in compliance with this chapter shall be considered a separate
violation.
Nonprofit organizations exempted from taxation under the provisions of the Internal Revenue Code shall be exempted from §
154-1, Subsections B, C, F, G and H of this chapter for the purpose of conducting public sales or auctions at premises owned by such nonprofit organization(s).
