A. The land owned by the Incorporated Village of Island
Park and (1) enclosed by a link wire fence extending approximately
from a continuation of the easterly line of Beach Way to the westerly
end of Norfolk Road and the continuation thereof and from the line
of said fence north of the northerly side of Block 15 and the easterly
continuation thereof to Block 8A, as designated by the official assessment
roll of said Village, and the northerly side of said Block 8A to the
high water mark of Island Park Harbor; and (2) all that parcel of
land beginning at a point formed by the intersection of the westerly
side of Washington Place and the high water mark of the Island Park
Harbor, running south to a point formed by the northeast corner of
Block 19; then westerly 469 feet to the northwest corner of Block
21; then north to intersection of the northeast corner of Suffolk
Road and the high water mark of the Island Park Harbor to the point
of beginning (designated as "Little Beach") shall be known as the
Island Park Beach Parks.
B. Wherever the words "Beach Park" or "Beach Parks" are
used in this article, they shall be deemed to mean both the singular
and the plural.

No person shall be permitted to enter or remain
upon said Beach Parks or the pier thereon at about the end of Waterford
Road except upon compliance with the provisions of this article.
Fishing from the pier located at Masone Beach is prohibited.

A. No person shall be permitted to enter or to remain
upon said Beach Parks from May 31 to and including September 15 of
each year unless he shall pay the charges for the use thereof as annually
established by resolution of the Board of Trustees.
B. Notwithstanding Subsection
A, children under the age of six years, when accompanied by an adult, shall not be required to pay any charges for the use of the Beach Parks.
C. Notwithstanding Subsections
A and
B, any person possessing and exhibiting a pass, permit or tag issued by order of and in accordance with the rules and regulations of the Board of Trustees shall not be required to pay the charge established by resolution of the Board of Trustees for admission and use of the Beach Parks.
D. Said Board of Trustees shall have the power to adopt
and establish the charges to be paid for the admission and use of
the said Beach Parks.
E. Entrance to the Beach described under Subsection
A shall be made only through the gate or gates providing entrance to said Beach Park.

A. No person shall park a vehicle within the Beach Parks, or within the parking field designated by the Board of Trustees as a beach parking field and used as such from May 31 to and including September 15 of each year unless he shall pay the charges for the use thereof as annually adopted and established by resolution of the Board of Trustees for the use of said parking area, in addition to the charges adopted and established by the Board of Trustees as provided for in §
166-8, or unless he shall have a pass, permit or tag issued by order of and in accordance with the rules and regulations of the Board of Trustees, which shall be empowered to adopt reasonable rules and regulations concerning the issuance of passes, permits and tags for the benefit of taxpayers of the Village of Island Park, residents of Island Park and their respective guests.

B. The Board of Trustees shall have the power to adopt
and establish the charges to be paid for the admission and use of
the beach parking fields.

C. Notwithstanding Subsections
A and
B, no person shall park a vehicle within the beach parks between the hours of 9:00 p.m. and 9:00 a.m.

No person shall dress or undress in the Beach
Park.

No person shall bathe, wade or swim in any water
adjacent to the Beach Park, except at such time and in such places
as the Board of Trustees shall designate as bathing areas and in such
areas designated as bathing areas by flags, signs and in conformity
with any oral instructions that may be given by the lifeguards on
duty.
No organized picnics or outings shall be conducted
in the Beach Park unless a permit is previously granted by the Board
of Trustees.
No person shall throw, cast, catch, kick or
strike any baseball, golf ball, football, basketball, or other object
except in places in the Beach Park designated therefor.
No person shall use, ride or drive a horse in
or upon any portion of the Beach Park.
No person shall erect any structures, stand
or platforms, hold any meeting, perform any ceremony, make a speech,
address or harangue, exhibit to the public any dramatic performance,
or the performance in whole or in part of any interlude, tragedy,
comedy, opera, ballet, play, farce, minstrel, dancing, entertainment,
motion pictures, circus, juggling, rope-walking, or any other acrobatics;
engage in any parade, drill, maneuver, or civic or other procession
in the Beach Park, except by previous permit from the Board of Trustees.
No person shall solicit alms or contributions
for any purpose in the Beach Park hereby created, unless by special
permit granted by the Board of Trustees.
No person owning or being custodian or having
control of any animal shall cause or permit such animal to enter the
Beach Park, and any such animal found at large may be impounded.
No person shall take into, carry through, leave
in, or throw, cast, lay, drop or discharge into or on, or suffer or
permit any servant, agent, employee or person in his or her charge
to take into, carry through, leave in, or throw, cast, lay, drop or
discharge into or on the Beach Park or the water adjacent thereto
any ashes, dross, cinders, shells, paper, dirt, sand, oil, grease,
clay, loam, stone, or building rubbish, hay straw, oats, sawdust,
shavings or manufacturing, trade or household waste, old iron or other
metal or objects made therefrom or rubbish of any sort, or sick, diseased
or dead animals, organic refuse, or other offensive matter, including
swill, brine, urine, offal, fecal matter, garbage or rubbish.
It shall be unlawful to bring or possess glass
containers of any type upon the Beach Parks. No person shall throw,
cast, lay or deposit any glass bottle or piece of crockery, nor any
glass or glassware or any part thereof, or metallic substance on any
bathing area in or adjacent to the Beach Park.

No food shall be eaten within the Beach Park,
nor shall any packages, parcels, or receptacles containing food be
opened in such Beach Park, except in such areas as may be designated.
No person shall cut, injure, deface or post
any sign or notice upon the fence enclosing the Beach Park.
No person shall, without a special permit from
the Board of Trustees for the Beach Park, notwithstanding any other
permit that may have been issued to him, hawk, peddle, sell or offer
for sale, hire or lease any object or merchandise or any other thing,
corporeal or incorporeal.
No person shall bathe, wade, swim or act in
any manner in the waters adjacent to the Beach Park in such a way
as will endanger his own or the safety or health of other users of
said waters, or reasonably interfere with their free and proper use
of the same.
The Village may employ lifeguards to protect
the safety and health of the users of the Beach Park and of the waters
adjacent thereto, and to safeguard the enjoyment of the users thereof,
and no person shall refuse or fail to obey the lawful and reasonable
request or command of said lifeguards designed to enforce compliance
with this article.
A. No person shall operate a boat in the waters adjacent to the Beach Park in violation of the restrictions set forth in Chapter
183, Boats and Boating.
B. No boat shall be moored or anchored in such waters
during the hours when such Beach Park is open for admission to the
authorized users thereof.

Any person committing an offense against this
article shall be guilty of a violation punishable by a fine not exceeding
$250 or by imprisonment for a period not exceeding 15 days for each
offense, or by both such fine and imprisonment.
