By the adoption of this article, the Village Board
of the Village of Morrisville declares its intent in doing so to be
to regulate and control, in a manner consistent with the interest
of the citizens of the Village of Morrisville, the manner in which
the members of the Village will be required to maintain their dwellings
and premises within the Village of Morrisville. The maintenance required
will be viewed towards promoting the health, welfare and sanitation
of the Village.

The Village Board hereby declares that the owner of
a dwelling and the property upon which it rests shall maintain the
same in good repair. The premises shall be clean and free of garbage,
rubbish, dirt, filth, vermin, rodents and any other things or matter
which can be considered dangerous to life or health. Where such conditions
exist, it shall constitute a hazard to property and persons and be
a public nuisance.

Such materials considered may be highly flammable
and sometimes explosive. Such may also contain acid or various poisons
harmful and potentially harmful to humans. Such materials considered
may contain or consist of sharp metal or glass edges or points upon
which a human could receive serious cuts and abrasions. The presence
of rubbish and garbage may also attract rats and other vermin and
be a health hazard. The presence of such materials even in areas zoned
for business or industry is unsightly and tend to detract from the
value of the surrounding land of said property.

It is also the Village Board's intent that a tenant
shall also be liable if a violation is caused by his own willful act,
assistance or negligence or that of any member of his family or household
or his guests.
As used in this article, the following terms
shall have the meanings indicated:
Includes all waste food, papers, dead animals or parts thereof,
ashes, offal, vegetables, dross, cinders, shells, straw, shavings
and all waste materials which shall be flammable or capable of fermentation
or decay.
Garbage, rubbish, or material of any kind, discarded, dropped,
thrown, abandoned or deposited in any manner except as expressly permitted
under this chapter.

Include an individual, society, club, firm, partnership,
corporation or association of persons; and the singular number shall
include the plural.
Includes all waste metal, tin cans, ashes, cinders, glass,
pottery, fabric, paper, remains of destroyed or partially destroyed
buildings or other structures, automobile and vehicle parts and all
discarded substances of a solid nature, whether combustible or noncombustible.

One who temporarily holds or occupies land, a building or
other property owned by another.

Any person who commits or permits any acts in violation
of any of the provisions of this article shall be guilty of a violation
and, upon conviction, shall be subject to a fine of not more than
$250 per day for every day the offense occurs or imprisonment for
a period not to exceed 15 days, or both.

The Village also has the option to pursue enforcement
of this article through civil proceedings.
C.Â
Members of the Village Board and the Code Enforcement
Officer have the sole power to issue an information and/or a summons
to further the enforcement proceedings. Prosecution shall be made
by the Village Attorney or by any member of the Village Board or by
the Code Enforcement Officer. Jurisdiction shall be with the Village
of Morrisville Justice Court.
D.Â
In addition to the above-provided penalties and punishment,
the Village Board may also maintain an action or proceeding in the
name of the Village in a court of competent jurisdiction to compel
compliance with or restrain by injunction the violation of such Article.
