This chapter shall regulate the construction, use, operation and maintenance of water supply systems in the Town of Wallkill and shall include the regulation of service connections.
A. 
Word usage.
(1) 
Words used in the present tense include the future; the singular number includes the plural; and the masculine shall include the feminine.
(2) 
Shall is mandatory; may is permissive.
B. 
Definitions. Unless otherwise expressly stated, the following terms shall, for the purposes of this chapter, have the meanings herein indicated:
AMERICAN SOCIETY FOR TESTING MATERIALS SPECIFICATIONS (herein referred to as "ASTM" or "federal specifications")
The latest published amendments or revisions applicable at any time to such specifications.
AMERICAN WATER WORKS ASSOCIATION (herein referred to as "AWWA")
The latest published amendments or revisions of the standards.
COMMISSIONER
The Commissioner of Public Works of the Town of Wallkill or the Town officer having charge of public works in the Town.
COMMUNITY WATER SUPPLY SYSTEM
All water systems where a common source of water supply serves two or more separately owned properties.
CROSS-CONNECTIONS
Any physical connection or arrangement between two otherwise separate water supply piping systems, one which contains potable water and the other water of unknown or questionable safety, whereby water may flow from one system to the other, the direction of the flow depending on the pressure differential between the two systems.
DISTRICT
Any Town water district.
HOUSE SERVICE
Includes street service and private property house service.
HOUSE SERVICE, PRIVATE PROPERTY
That portion of the house service between the curb box and the building being served.
HOUSE SERVICE, STREET
That portion of the service line which connects to the water main in the street and ends with the curb box, located between the pavement and the property line.
INSPECTOR
The Commissioner of Public Works, the Superintendent of Sewer and Water, the Town Engineer or the person or persons appointed and duly authorized by the Town to inspect and approve the installation of waterlines and their connection to any water system.

That study entitled "Water Supply Distribution and Storage, Town of Wallkill, Orange County, New York," approved by the Town Board by resolution dated December 1, 1965.
NEW YORK STATE CONSERVATION DEPARTMENT, WATER SUPPLY SECTION
That section of the New York State Department of Health that deals with the approval of the plans and specifications for the construction of water supply systems.
NEW YORK STATE DEPARTMENT OF TRANSPORTATION (NYSDOT) ITEM 4

A complete analysis of the chemical and physical characteristics of water.
WATER MAIN
The large pipe in the street conducting water from one end of the street to the other.
WATER SUPPLY SYSTEMS
Water supply systems of or within a Town water district and water supply systems within real property subdivisions, whether or not within a Town water district, and includes any and all water systems where a common source of water supply serves two or more separately owned properties.
A person owning any property being subdivided for residential or commercial use where the regulations or requirements of the New York State Department of Health require a community water supply system shall install such a system. The installation shall be at the expense of the person so subdividing the property.
A. 
In the Town Consolidated Water District No. 1, connection for existing structures shall be made within a time limitation, to be established by resolution of the Town Board after notice given by publication in the official newspaper of the Town, following completion of a Town water system. New buildings in the district shall be so connected before a certificate of occupancy shall be issued. Provisions shall be made by the property owner for the installation of a water meter and for connection to the public water supply in any area within the district where a water supply is shown on a Town-approved plan or is under construction, before a certificate of occupancy may be issued.
B. 
Prior to the issuance of a temporary or final certificate of occupancy, all water valves, curb boxes, hydrants, water meters, and related ancillary items shall be visually observed for proper operation by the Town of Wallkill Water Department or its designated representative. Additionally, as-built water and sewer utility plans shall be prepared in conformance with § 242-4B (including GPS coordinates for all valves, curb stops, and manholes) to be provided by the owner/developer to the Commissioner of Public Works.
A. 
It shall be the duty of the Town's inspector to enforce the provisions of this chapter.
B. 
The inspector or any other duly authorized employee of the Town of Wallkill bearing proper credentials and identification shall be permitted to enter upon all properties for the purposes of inspection, observation, measurement, sampling and testing in accordance with the provisions of this chapter.
C. 
An application for a building permit under Chapter 82, Building Construction, shall include plans for a connection into the public water supply system if such is available, or if not, plans for a well or other source of water supply shall be submitted with the application.
No person shall uncover, make any connections with or opening into, use, alter or disturb any public water supply system or appurtenance thereof without first obtaining a written permit from the inspector.
A. 
There shall be two classes of water service connection permits:
(1) 
For all buildings using water meters of the standard size of 5/8 inch by 3/4 inch.
(2) 
For all other buildings using meters of a larger size than 5/8 inch by 3/4 inch.
B. 
The Town Board shall, by resolution, determine the fees to be paid for all water service connection permits.
C. 
In all cases, the owner or his agent shall make application for the permit on a form furnished by the Town. This permit application shall be supplemented by such plans, specifications or other information considered as pertinent in the judgment of the inspector.
D. 
Any water use different from the class of permit applied for shall be a violation of this chapter.
All costs and expense incident to the installation of the water service connection to the building shall be borne by the owner. The owner shall indemnify the Town from any loss or damage that may directly or indirectly be occasioned by the installation of the water service line.
A. 
Any use of water during the construction of a proposed project without a water meter is prohibited unless approved by the Water Superintendent. A temporary construction water meter assembly must be obtained through the Water Department, and a designated hookup location is to be approved by the Water Superintendent.

B. 
The water service line in the building shall have a shutoff both before and after the meter for checking by the Town.
C. 
All water service piping shall be type "L" copper (in accordance with New York State Plumbing Code) from the point of the most upstream ball valve, through the proposed meter and all appurtenances, to the most downstream ball valve where the connection to the existing service or interior distribution piping is made.
D. 
Metering of water services for fire-suppression sprinkler systems is not required if a separate sprinkler line is installed for that purpose only.
E. 
The water meter is to be located within the building to be served. Said meter shall be readily available and accessible for checking by a representative of the Town of Wallkill. All meters shall be sealed by the Town, and the removal of such seal, unless authorized by the Town, shall be a violation of this chapter.
F. 
Any tee, fitting or water connection made between the meter and the water main, other than the required curb stop, shall constitute a violation of this chapter.
G. 
All water meters shall be installed to the following specifications:
(1) 
A ball valve equal to the size of service line shall be installed immediately after the entry of the water service pipe into the building.
(2) 
Where water pressure within a building exceeds 80 psi static, an approved water-pressure reducing valve conforming to ASSE 1003 with strainer shall be installed to reduce the pressure in the building water distribution piping to 80 psi static or less.
(3) 
Where water pressure within a building is less than 40 psi static, an approved water pressure booster system must be installed to maintain a minimum of 40 psi static, but not to exceed 80 psi static.
(4) 
An appropriate meter supplied by the Town of Wallkill shall be installed. The meter must be purchased from the Town of Wallkill Water Department. The cost of the meter and the meter installation shall be borne by the owner.
(5) 
A double-check valve (Watts No. 7 or equal) must be installed downstream from the meter.
(6) 
Services and meters over one inch shall be designed by a licensed New York State professional engineer and submitted to the Town Water and Sewer Superintendent for review. Services and meter assemblies must include backflow prevention devices and be designed and installed in strict accordance with New York State Health Department regulations and the New York State Plumbing Code.
(7) 
A pressure-relief valve set at 150 pounds must be installed downstream from check valve.
(8) 
Install expansion absorber (Amtrol ST-5, ST-12 or equal) downstream from relief valve.
(9) 
Install ball valve equal to the size of the service line downstream from expansion tank.
A. 
The place of connection shall be shown on the plans and stated in the application.
B. 
The name of the person who will actually make the connection shall be specified on the application. This person shall be authorized and approved by the Town of Wallkill to tap the water mains.
C. 
The time of such connection shall be stated so as to give the inspector at least two days' advance notice.
D. 
The house service (refer to Detail 7W[1]) shall consist of the following: a corporation stop tapped in the main or in a special collar. Connected to this shall be a minimum three-fourths-inch copper service, Type K. This copper service shall extend to a point behind the property line and, at this point, shall be provided with a curb stopcock in a curb box. From the curb stop to the house, the water service line shall be minimum three-fourths-inch copper, but shall comply with the Plumbing Code of New York State (2010 Edition).

E. 
Each dwelling or building shall be provided with a backflow prevention device. The backflow prevention device shall be listed as acceptable by the New York State Department of Health in Technical Reference PWS 14.
F. 
Owners of commercial and industrial buildings shall have the backflow prevention devices tested once a year. A certified copy of the test results will be submitted to the Town.
G. 
Street excavations. No street excavation in any public street or highway shall be made by any person unless a street opening permit has been obtained from the Town. Street excavations shall be made so as to cause as little interruption in street traffic as is possible. All openings in streets shall be barricaded and, if left open at night, shall be provided with satisfactory lights. Not more than 1/2 of the street shall be dug up at one time, in order to facilitate the flow of traffic.
H. 
Proposed water main or services will be constructed and in accordance with Details 1W to 6W,[2] as applicable. The use of K-Crete shall be used as backfill only within existing Town roads.

I. 
All excess dirt and other material shall be carefully cleaned from the road, and the road, except for the trench area, shall be restored to its original surface. Excess material excavated from the trench shall be removed from the site.
J. 
Within seven days after installation of the water service line, the road pavement shall be restored to a similar or better condition than the surrounding pavement.
K. 
Water service lines shall be placed in a separate trench at least 10 feet horizontal from any sanitary sewer, stormwater, catch basin, manhole or sewer connection, measured from the edge of pipe to the edge of pipe.
L. 
Water service lines which cross a sewer shall cross at right angles, with a minimum vertical clearance of 18 inches.
M. 
All water service lines shall be installed with a minimum of 4 1/2 feet of cover.
N. 
All such installations shall be inspected by a Town-authorized inspector, with the water main and services under pressure, before backfill is made.

O. 
Any use of ninety-degree bends is prohibited unless specifically authorized by the Town of Wallkill Water and Sewer Superintendent.
P. 
Penetrations of ductile iron pipe, two inches and greater, through commercial or residential buildings shall be sleeved and sealed with an approved link seal from Thunderline Modular Seals or approved equal.
Q. 
Penetrations of "K" copper (two inches or less) through commercial or residential buildings shall be sleeved and sealed with hydraulic cement or approved equal. A watertight bond breaker shall be required around copper pipe.
R. 
Any existing water services to be abandoned within the Town of Wallkill Water District shall be thoroughly coordinated with the Town of Wallkill Water Department and, at a minimum, are to be removed to the supply main, turned off at the corporation stop and capped with a solid brass cap and encased with an abandonment corporation cap (as manufactured by Ford Meter Box Company, O.A.E.).

In case a house or other building is to be closed or become vacant, notice thereof shall be given the inspector in order that the meter may be read and curb stop closed. Where such notice is not given and pipes burst from freezing or other cause, the value of the water lost by reason thereof, as estimated by the inspector, shall be added to the next bill and be paid in like manner as regular water charges.
Prior to the operation of any curb stop, notification and coordination with Town Water Department is required. Ownership of and responsibility for all curb stops remain the individual property owners. Where a new connection is made with street mains and where new extensions or attachments are made in unoccupied houses, the curb stop shall be closed by the person making the connection, extension or attachment. Notice of completion of the work shall be given the inspector, and the curb stop shall not again be opened until the work has been inspected and approved by the inspector and the meter read. Pipes and connections between the main and meter shall not be covered until so inspected and approved. Prior to the issuance of a temporary or final certificate of occupancy, the curb box shall be checked and visually observed for proper operation.
A. 
Where a three-fourths-inch meter fails to register the correct quantity of water delivered through it or where it otherwise becomes out of order or in need of repair, notice thereof shall be given the inspector. Another meter shall then be installed during the time required for testing and repair. Where repairs are found necessary, the same shall be made at the district's expense. When, in the opinion of the inspector, a meter becomes unsuitable for further use, it shall be replaced by another at the district's expense. Any meter greater than 3/4 inch deemed necessary for replacement by the Superintendent of Water and Sewer will be replaced at the owner's expense. Where any meter shall be damaged, it shall be repaired or replaced by the district, and the cost of repair or replacement shall be charged to the property owner.
B. 
Where the Town requires that any meter be changed, modified, upgraded or otherwise altered and the Town or the Town's contractor or other designee provides notice to the property owner that access is required to the property to make said changes, modifications or alterations, and the property owner fails to provide access within the time set forth in the notice, the Town shall assess a fine, surcharge or penalty to the property owner for the failure to provide access. Said fine, surcharge or penalty shall be the sum of $25.
Plans, including detail specifications for constructions and materials, for the proposed extension of any water main in streets within an existing district shall be submitted to and receive the approval of the Town Engineer prior to installation. Connection to existing mains shall be made under the supervision of the Town Engineer and shall, in general, be made under pressure by a person experienced in such installation.
All mains shall be a minimum of six inches in diameter and shall be adequate for fire-protection purposes. Dead-end mains over 600 feet long shall be a minimum of eight inches in diameter and shall be provided with a hydrant.
House services shall be installed to each existing house at the time the water main is placed in the street, within the limitation of time ordered by the Town.
When a new water supply system is contemplated to serve a proposed subdivision or other area within the Town, approval of such supply shall be obtained from the Water Resources Commission of the New York State Conservation Department and from the Water Supply Section of the New York State Department of Health. Such approval shall cover the source of supply as well as the details of the water system installation. The plans shall also comply with all Town and New York State Department of Health regulations.
The person proposing such water supply system shall, at the option of the Town, be required to form a water district and offer said utility to the Town. The formation of a water district will require the concurrent approval of the Town of Wallkill Planning Board and Town of Wallkill Water and Sewer Superintendent.
The detail specifications which are a part of this chapter shall be followed as concerns the materials and method of installation of the water mains, house service, meters and all other parts of the system.[1]

The Master Plan for the Town of Wallkill water supply distribution and storage shall be followed so that the new water supply may be incorporated in the overall system for the Town of Wallkill.
Alternate materials and methods of construction may be used if they have been specifically approved by the Commissioner of Public Works and the Superintendent of Water and Sewer. An alternate may be approved, provided that the proposed design is satisfactory and complies with the intent of this chapter and the material or method of work offered is, for the purpose intended, at least the equivalent of these here prescribed in quality, strength, effectiveness, durability and safety.
A. 
All pipe, fittings, valves, blowoffs, fire hydrants and appurtenances shall conform to American Water Works Association (AWWA) standards, latest revision, New York State Plumbing Code, and the attached details.[1]

B. 
The design, installation and testing of any water system shall conform to applicable AWWA standards, Town of Wallkill specifications and New York State Department of Health regulations.
C. 
All water mains shall be designed to maintain a minimum pressure of 20 pounds per square inch at ground level at all points in the distribution system under all conditions of flow. The normal working pressure in the system should be approximately 60 pounds per square inch and not less than 35 pounds per square inch.
D. 
The minimum water main size shall be six-inch diameter.
E. 
Systems shall be designed to provide fire flows in accordance with the requirements of the State Insurance Services Office.
F. 
Valves shall be provided at each street intersection, at each place where a main is tapped and at intervals of not more than 500 feet in commercial districts and 800 feet in other districts and at intermediate locations as required by applicable regulations.
G. 
Hydrants should be provided at each street intersection and at intermediate points between intersections. Hydrant spacing may range from 350 feet to a maximum of 600 feet.
H. 
Individual house service connections of size three-fourths-inch to two-inch shall be installed in one continuous piece from the main to the curb stop and in one continuous piece from the curb stop to the meter. Unless specifically authorized by the Superintendent of Water and Sewer, no unions of any nature will be permitted below floor slabs.
I. 
Prior to beginning the installation of waterlines, the developer shall submit to the Superintendent of Water or his duly authorized representative the following items for review and approval:
(1) 
The manufacturer's shop drawing for pipes.
(2) 
The manufacturer's shop drawing for fittings.
(3) 
The manufacturer's shop drawing for hydrants.
J. 
Any use of ninety-degree bends is prohibited unless specifically authorized by the Town of Wallkill Water Superintendent.
K. 
All water main and service lines shall have detectable warning tape placed 24 inches above pipe. Warning tape to read "Caution Buried Water Line Below."
L. 
All ductile iron pipe joint shall have two bronze wedges for conductivity.
A. 
Water pipe installed in Town roads, in rights-of-way or in a water system or systems to be dedicated to the Town shall be ductile iron pipe, Class 52, with a rated water working pressure of 350 pounds per square inch. Ductile iron pipe shall be manufactured and installed in accordance with AWWA C151, AWWA C111, AWWA C104 and AWWA C600, latest revisions.
B. 
Water pipe installed in nondedicated roads or private water systems may be polyvinyl chloride (PVC) pressure pipe, such as Blue Brute or approved equal. PVC pipe shall be manufactured and installed in accordance with AWWA C900 and M23, latest revisions.
C. 
Water main fittings shall be standard gray-iron and ductile-iron fittings in accordance with AWWA C110, latest revision. Fittings shall be the mechanical joint retainer gland type. Mechanical-joint retainer glands, bolts and gaskets shall be in accordance with AWWA C111, latest revision.
D. 
Water main valves four inches through 48 inches shall be resilient wedge gate valves, as manufactured by Mueller, Model No. A-2360, nonrising stem, standard mechanical joint ends, in accordance with AWWA C509 and AWWA CIII, latest revision. Valves shall be provided with an extension service box to grade; see Typical Water Valve Detail 9W.
E. 
Hydrants shall be dry-barrel hydrants, type Mueller Super Centurion model A-423 (open left), in accordance with AWWA C502. (See attached Detail 10W.) Hydrants shall have a main valve size opening of five inches nominal, one four-and-one-half-inch NST pumper nozzle, two two-and-one-half-inch NST hose nozzles, a one-and-one-half-inch pentagon operating nut and a six-inch mechanical joint inlet show connection with accessories. The hydrant direction of opening shall be left (counterclockwise).
F. 
Service taps on polyvinyl chloride (PVC) pipe shall be made using a bronze Mueller (CC) thread service clamp. The clamp shall be of a double strap construction, sized according to the main pipe size and tapping size.
G. 
Corporation stops for three-fourths-inch and one-inch service lines shall be Mueller H-15008 conductive compression. Corporation stops for one-and-one-half-inch and two-inch service lines shall be Mueller H-15013 conductive compression. Corporation stops shall be in accordance with AWWA C800, latest revision.
H. 
Curb stops for three-fourths-inch through two-inch shall be Mueller H-15219 conductive compression, with drain. Curb stops shall be provided with an extension service box to grade. Curb stops shall be in accordance with AWWA C800, latest revision.
I. 
Underground service lines for sizes three-fourths-inch through two-inch shall be Type K copper, supplied in conformance with ASTM 888, in accordance with AWWA C800, latest revision.
J. 
Service connections or water main extension connections of three inches or larger shall be made by means of an approved tapping sleeve and tapping valve. Mechanical joint tapping sleeves shall be provided with duck-tipped end gaskets. Outlet flange shall be Class 125, ANSI B16.1.
K. 
A cast-iron tapping sleeve and valve is to be used in all cases, except when the existing main is transite. In this case, the tapping sleeve is to be stainless steel.

A. 
All water pipe shall be installed in a separate trench from any other underground utility.
B. 
All excavations for pipe shall be carried six or more inches deeper than the final grade line and then brought to grade in accordance with the attached details.
C. 
The width of the trench at the top of the pipe shall not exceed the diameter of the pipe plus 24 inches.
D. 
Materials such as peat or other soft material shall be reported to the Commissioner of Public Works and the Superintendent of Water and Sewer. In the event that rock is encountered, excavation shall be carried eight inches below the bottom of the pipe.
E. 
The excavation of trenches shall be fully completed a sufficient distance in advance of laying the pipe but not more than 50 feet, unless permitted by the Commissioner of Public Works, and the exposed end of all pipe shall be fully protected to prevent earth or other substances from entering the pipe. The interior of the pipe shall be carefully freed from all dirt or superfluous material as the work progresses.
F. 
The contractor shall remove, by pumping or other means, any water accumulated in the excavation and keep the trench dewatered until the bedding is complete.
G. 
The contractor shall do all bracing, sheathing and shoring necessary to perform and protect all excavation as required for safety or to conform to governing laws.
A. 
No pipe or other appurtenance shall be backfilled until inspected by the inspector.
B. 
Backfilling shall be done with approved material, free from large stone or frozen earth.
C. 
Immediately after pipes have been laid, backfilling shall commence. The material surrounding the pipe and the pipe embedment zone shall be carefully placed and thoroughly compacted in such a manner that the line and grade of the pipe are not disturbed. Backfill material shall be placed evenly and carefully on both sides and over the pipe in nine-inch maximum lifts, and each lift shall be thoroughly compacted. See typical water main details.
D. 
Where the pipe is installed in a utility easement right-of-way (not under a paved, hard surface, or surfaces exposed to vehicular traffic and/or loadings), the trench above the pipe embedment zone shall be backfilled in accordance with detail(s) sheet (3W).

A. 
All types of installed pipes shall be pressure tested and leak tested in accordance with AWWA C600, Section 4, latest revision.
B. 
All tests shall be conducted in the presence of the Town's inspector.
All new, cleaned or repaired water mains shall be disinfected in accordance with AWWA C651, latest revision, except that Section 5.1, Tablet Method, shall not be permitted.
Repairs to water mains or water service connections shall be made with such materials as are prescribed by this chapter for new work, insofar as is practical, or by following the recommendations of the manufacturer of the original material.
In the Town water district, maintenance of the water service line from the water main to the property served is the responsibility of the property owner. In the event that a leak develops and is not promptly repaired by the owner, the Town may repair the same and assess such charge against the property so benefited, such charge to be collected as a tax.
In the Town water district, the applicant for a building permit shall notify the inspector when he is ready to connect the water service line to the main and the water service line to the building. This connection shall be made under the supervision of the inspector or his representative.
A. 
All measurements, tests and analysis of the characteristics of the waters to which reference is made in this chapter shall be determined in accordance with Standard Methods for Examination of Water and Waste Water, published by the American Public Health Association, Inc.
B. 
All water mains are to be hydrostatically pressure testing in accordance with the applicable sections of AWWA, latest revision.
C. 
All tapping sleeves and valves are to be air tested and visually observed for leaks.
D. 
All water mains are to be disinfected, sampled, and acceptable analytical results obtained prior to placing in service. Testing, disinfection and sampling parameters are to be in accordance with the applicable sections of AWWA and the New York State Department of Health, date of latest revisions, except that Section 5.1 of AWWA C651, Tablet Method, shall not be allowed.
E. 
All water services less than three inches (diameter) are to be visually observed for leaks, prior to backfill.
A. 
No person shall open, interfere with or draw water from any fire hydrant without approval from the Commissioner of Public Works or the Superintendent of Water and Sewer, except that hydrants may be opened by or on the order of any Chief of a Fire Department for fire-fighting purposes only. All other uses require prior approval of the Commissioner of Public Works or the Superintendent of Water and Sewer. If use of hydrant is approved, an approved water meter shall be obtained from the Town of Wallkill Water Department, at the sole expense of the applicant.
B. 
Whenever a hydrant has been opened and used, notification of such fact shall be promptly given the inspector.
C. 
No tools or implements except standard hydrant wrenches shall be used.
D. 
All privately owned and maintained fire hydrants are to be routinely flushed at a semiannual basis. Flushing operations are to be coordinated with the Town of Wallkill Water Department. Annual reports in this regards are to be prepared and provided to the Town of Wallkill Water Department and Building Department. The Water and Sewer Superintendent reserves the right to require that the flushing reports be certified by a licensed New York State professional engineer or plumber.
The Town reserves the right, in its sole discretion, to limit the amount of water furnished to any consumer should circumstances of public necessity warrant such action, even though no such limit may be stated in the application or permit for use; or said Town may entirely shut off the water supply used for any manufacturing purposes or for furnishing power or for lawn sprinkling, at any time, by giving reasonable notice by publication, if possible, of such intended action; or in the case of making or constructing new work or in making repairs or in an emergency, the right is reserved to shut off the water from any consumer without notice for as long a period as may be necessary.
The Town of Wallkill shall not be liable for any damage or loss of any kind to persons or property which may arise from or be caused by any change, diminution in or increase to the water pressure or supply from any cause whatever, nor shall the Town of Wallkill be liable for any property damages resulting from any discoloration of the water furnished, including, but not limited to, clothing allegedly damaged by discolored water.
Subject to change, a schedule of rates, penalties, minimum charges and fees for water service permits shall be established by the Town Board. Such schedule of rates shall be filed and made available for public inspection at the office of the Town Clerk and at such other Town offices as designated by the Town Board.
Bills for water services shall become due and payable to the districts at such place and to such person as designated by the Town Board and shall be rendered for such billing periods as the Town Board shall designate. If such bills are not paid within 30 days after the due date designated by the Town Board, a penalty will be added thereto. If such bills remain unpaid for a period of 60 days from the due date, water service may be discontinued by order of the Town Board until such bill, together with the penalty, is paid.
A. 
Water rents and charges and penalties thereon shall be a lien upon the real property upon which the water is used, and on or before the day when, under the Town Law, preliminary estimates or expenditures are required to be submitted, the inspector shall file with the Town Clerk a statement showing all water rents and charges, with penalties thereon, unpaid for more than 60 days, which said statement shall contain a brief description of the property to which the water was supplied or upon which charges were incurred, the tax account number, the name of the owner liable to pay the same, so far as may be known, and the amount chargeable to each.
B. 
Such rents, charges and penalty shall not be collected by the collector of the districts after the filing of such statement with the Town Clerk but may be thereafter paid to the Supervisor until such time as a statement of such unpaid water rents, charges and penalties is submitted to the Board of Supervisors for the purpose of levying the same as a tax against the property affected.
Any person who shall, except as permitted by this chapter, break, damage, destroy, uncover, deface or tamper with any structure, apparatus or equipment which is part of any public water supply system or any community water supply system shall be deemed to have violated this chapter. Any person who commits or permits any acts in violation of any of the provisions of this chapter shall be deemed to have committed an offense against such chapter and shall be liable for the penalties provided. A separate offense against this chapter shall be deemed committed on each day during or on which a violation occurs or continues. A separate penalty may be imposed for each separate offense.
For each violation of a provision of this chapter, the person violating the same shall be subject to a fine of not more than $50 or imprisonment not to exceed six months, or to both such fine and imprisonment.
Any person violating this chapter shall be subject to a civil penalty enforceable and collectible by the Town in the amount of $50 for each offense.
In addition to the above-provided penalties, the Town Board may cause water service to be cut off to any property where a violation exists. The Town Board may also maintain an action or proceedings in the name of the Town in a court of competent jurisdiction to compel compliance with or to restrain by injunction the violation of such chapter.
A. 
No water wells, for potable use or irrigational purposes, will be permitted within Town of Wallkill water districts.
B. 
Any/all existing wells proposed to be abandoned shall be done in accordance with the NYSDOH regulations, and certificate letters in this regard are to be prepared by a New York State licensed professional engineer and provided to the Town of Wallkill.
A. 
Restraints approved for use are thrust blocks, mega lug retainer glands, tie rods and field lock gaskets.
B. 
Two forms of restraints are required on all bends, offsets, dead ends and/or temporary dead ends for future expansion. Hydrants will require additional restraints, in accordance with Detail 10/W. All dead ends are to have thrust calculations designed by a licensed New York State professional engineer and submitted to the Town for review.

C. 
Any water main 4 inches and greater requires a restraint chart designed by a New York State licensed professional engineer in accordance with all applicable standards, including but not limited to AWWA, NYSDOH, etc.
