The Borough and the Authority shall have the right of access at all reasonable times to any part of any improved property served by the sewer system as shall be required for purposes of inspection, observation, measurement, sampling, testing, the examination and copying of records and for performance of other functions relating to service rendered by the Borough through the sewer system or responsibilities of the Authority with respect to the sewer system.
A. 
The Borough reserves the right to adopt by resolution and promulgate from time to time additional classifications and sewer rates or charges therefor or modifications of the schedule of sewer rates or charges as set forth in this article, which additional classifications and sewer rates or charges or modifications, as the case may be, shall be construed as a part of this article.
B. 
The Borough reserves the right to adopt, from time to time, such rules and regulations, in addition to provisions of this chapter, as it shall deem necessary and proper in connection with the use and operation of the sewer system and discharge of wastewaters and other substances thereto, which rules and regulations shall be, shall become and shall be construed as part of this chapter.
If any provision, paragraph, word, section or article of this chapter is invalidated by any court of competent jurisdiction, the remaining provisions, paragraphs, words, sections and ordinance shall not be affected and shall continue in full force and effect.
The Sewer Authority appoints the Borough of Shippensburg, Pennsylvania, as its agent in all respects for the administration and issuance of permits and orders and conducting hearings relative to use of the sewer system and for operation and maintenance of the sewer system under this chapter and other applicable ordinances, to the extent permitted by law, as long as the lease agreement (dated August 29, 1978) is in existence. On termination of the lease agreement, for any reason, the management of this industrial pretreatment program immediately and automatically reverts to the Shippensburg Borough Authority. Hearings pursuant to § 127-41 of this chapter shall be held by the Borough Council. Legal action, when required to be taken by the Borough Solicitor, shall be commenced upon notice from the Borough or other evidence of violation of this chapter or other applicable ordinances.
A. 
All other ordinances and parts of other ordinances inconsistent or conflicting with any part of this chapter are hereby repealed to the extent of such inconsistency or conflict.
B. 
The headings in this chapter are solely for convenience and shall have no effect on the legal interpretation of any provision hereof.
This chapter took effect on the 20th day of October 2009. The Borough reserves the right to make changes from time to time, as in its opinion may be desirable or beneficial, and to amend this chapter in such manner and at such times as, in its opinion, may be advisable.
All ordinances or parts of ordinances which are inconsistent herewith are hereby repealed.
