All telegraph or telephone poles that are or may be erected or maintained
in any of the streets of the city shall be permitted to be so erected and
maintained only upon the following conditions:
A. City to have use of poles. The city and the several departments
thereof shall, at all times, have the first right to occupy and use such poles
or any of them for supporting any wires used or that it may be desirable to
use and in such manner as the several departments may elect.
B. Owners and users to be responsible for damages. The owners
of and all persons using or maintaining such poles shall be responsible for
all damages that may result in consequence of the negligent erection, use
or maintenance by such owners or users of any such poles.
C. Subject to regulations of the Director of Public Works.
The erection, use and maintenance of all such poles shall at all times be
subject to the regulations and directions of the Director of Public Works,
and the owners and users of such poles upon the orders of the Director of
Public Works to do so shall change the location of, repair or remove such
poles.
Every person who shall remove, change the location of, or in any manner interfere with, any of the wires used by the city or any department thereof, without the consent of the Director of Public Works, shall be punished as provided in Chapter
1, General Provisions, Art.
I.
No person shall erect, use or maintain or shall cause to be erected,
used and maintained, do any work or be employed in erecting, using and maintaining
any pole in any public street of the city without permission therefor being
first obtained from the Director of Public Works.
The Director of Public Works is hereby authorized and empowered to grant
licenses, giving such licensees the right to run and maintain wires in, through
and across any of the public streets of the city, for the purpose of connecting
thereby detached and separate portions of their own premises, upon compliance
with such regulations as the Director of Public Works may make for the location
and maintenance of such wires.
All wires put up or maintained under the provisions of this chapter
or any other ordinance in any street in the city shall be put up and maintained
at a height of not less than twenty (20) feet above the surface of such street.
