A. 
The grantee shall not deny service, deny access or otherwise discriminate against subscribers, channel users or general citizens on the basis of race, color, religion, national origin, age, sex or physical or mental handicaps, provided that the subscriber shall pay all applicable fees for the service desired. The grantee shall comply at all times with all other applicable federal, state and local laws and regulations and all executive and administrative orders and rates relating to nondiscrimination which are hereby incorporated and made part of this chapter by reference.
B. 
Protection of subscriber privacy mandatory. The grantee shall at all times protect the privacy of subscribers, as provided in this chapter and other applicable federal, state and local laws.
C. 
The franchisee shall maintain and operate its communications system and business in an efficient manner and shall provide adequate, efficient and reasonable service to its customers in the city. The franchisee shall comply with all applicable federal, state and local laws, rules and regulations.
A. 
For telecommunications system construction and "extension after the effective date of this chapter, the grantee is required to construct, install and maintain capacity on its telecommunications system (such capacity to be referred to as the institutional network) to the locations indicated in the franchise. The institutional network (I-net) shall provide six fibers to each site, of which four fibers may be utilized for a SONET ring and two may be used for analogue transmission of video signals. The grantee shall activate the six fibers from each site. The institutional network and each institutional network location connection shall meet the specifications indicated in the franchise. Upon city request for additional fibers to be included in the fiber bundles to any I-net sites, the grantee shall provide the additional fibers at the city's expense based upon the grantee's incremental cost. For the purpose of this chapter, incremental material cost shall be defined as only that portion of the capital cost of the institutional network that exceeds the capital cost of the telecommunications network which, but for the additional capacity provided by request of the city, the grantee would incur in its normal course of providing facilities for its own use and purposes. The city shall be responsible for end-user equipment. Telecommunications systems constructed prior to the effective date of this chapter shall not be required to construct additional facilities for noncommercial educational and governmental purposes but shall provide such capacity on the system as may be specified in the franchise.
B. 
The grantee shall own and maintain the institutional network. The grantee shall not charge the institutional network users or the city for the construction of the institutional network, maintenance of the institutional network or use (including but not limited to video, voice and data transmission and other telecommunications applications) of the institutional network. The institutional network shall be used for noncommercial educational and governmental purposes. The institutional network may be connected to any communications system, including but not limited to existing institutional networks provided to the city.
C. 
The grantee shall construct the institutional network to additional city-owned buildings upon the request of the city at the city's expense. The expense to be borne by the city shall not exceed the grantee's actual time and materials cost of construction from the connection point to the nearest point on the institutional network.
D. 
Any telecommunications service area extensions shall provide for the institutional network at the same level and at no cost as provided in Subsection B above.
E. 
The institutional network shall be activated in conjunction with the construction of the telecommunications system.
F. 
Features incorporated into the system design shall permit institutions to transmit electronic signals to other telecommunications and cable television systems serving the area.
G. 
Under normal operating conditions, the grantee shall respond to technical problems on the institutional network within four hours, with the exception of public safety or critical city communications. In such cases, the grantee shall respond immediately.
