This article is being enacted pursuant to the Interlocal Services Act (N.J.S.A. 40:8A-1 et seq.) to authorize the County of Hunterdon to provide public health services of a technical and professional nature provided by the County Health Department, as agent of our Municipal Board of Health in compliance with the Local Health Services Act, P.L. 1975, c. 329 (N.J.S.A. 26:3A2-1 et seq.)
This municipality shall enter into a contract with the County of Hunterdon, essentially providing that the County Health Department shall provide public health services which meet the standards of core and elective activities enumerated in Standards of Performance, as promulgated by the Public Health Council of the State of New Jersey. The public health service activities are categorized under administrative and supporting services, environmental health, communicable disease, maternal and child health and chronic illness and are listed in said agreement. The Mayor and Clerk of this municipality are hereby authorized and directed to execute said agreement on behalf of this municipality.

A. 
There shall be established in the Township of West Amwell, pursuant to N.J.S.A. 26:3-3 et seq., a Board of Health which shall consist of seven members. These members shall be the members of the Township Committee together with two members appointed by the Mayor. The two non-Township Committee members will be appointed for terms of three years from the time of their appointment, except that the first of these appointed shall be appointed for a term of two years so that the term of not more than one non-Township Committee member shall expire in any one year.

B. 
There shall be also appointed by the Mayor two alternate members. These members shall be designated at the time of their appointment as "Alternate No. 1" and "Alternate No. 2." The term of the alternate members shall be for two years, except that of the first two alternate members appointed, one shall be appointed for a term of one year so that the term of not more than one alternate member shall expire in any one year.
C. 
A vacancy occurring in the position of non-Township Committee or alternate member other than by expiration of term shall be filled by the appointing authority for the unexpired term only.
D. 
Members may not be permitted to act on any motion in which he or she has either directly or indirectly any personal or financial interest. Members may, after public hearing, if requested, be removed by the governing body for cause.
E. 
An alternate member may participate in discussions of the proceedings but may not vote except in the absence or disqualification of a regular member. A vote shall not be delayed in order that a regular member may vote instead of an alternate member. In the event that a choice must be made as to which alternate member is to vote, Alternate No. 1 shall vote first.
The Clerk of the Township of West Amwell shall be the Secretary of the Board of Health.
The Board of Health shall have the powers and perform the duties prescribed by law and also by municipal ordinance. It shall be the duty of the Board of Health to enforce all ordinances of the Township which relate to public health and public nuisances.
The Board of Health shall hold at least five regular meetings each year. Special meetings may be called by the chairman or as provided by law.
The powers and duties of the Board of Health shall be coextensive with the limits of the Township.
The Board of Health established in accordance with this article shall succeed the presently existing Board of Health upon adoption and publication according to law.
