Pursuant to the authority provided in §
176-5 of the Code of the Village of Morrisville, the following regulations for the use of the public water system of the Village of Morrisville are to be in addition to all other applicable regulations previously and hereafter enacted by statute and/or resolution, be and hereby are enacted.
All water supplied to users connected to the
Village water supply system shall be measured through a meter supplied
and installed by the Village at the expense of the user. All meters
shall be read by a Village employee not less than once per year. In
the event the Village is unable, due to the noncooperation of the
property owner or occupant(s), to gain access to an existing meter,
the Village shall have the right, in its sole discretion, to install
a remote reading meter at the expense of the user.
It shall be the responsibility of the user to
pay for the repair or replacement of a damaged meter, whether the
damage is caused by freezing temperatures or any other cause which
could have been prevented by reasonable care and maintenance by the
user. All charges for meter repair and/or replacement shall be subject
to the same provisions for nonpayment as apply to nonpayment of water
bills.
The determination of the need to repair or replace
a meter shall be within the sole discretion of the Village and its
duly designated employees. If the Village changes a meter that has
malfunctioned solely as a result of age and normal wear and tear,
the Village shall bear the cost of such meter replacement. If the
Village elects to change or relocate a properly functioning meter
solely for the convenience of the Village, and not by reason of noncooperation
of the property owner or occupant(s), the Village shall bear the cost
of such meter replacement and/or relocation.
No person shall tamper with or break any meter seal, or disconnect, or in any way tamper with any water meter. A charge of $250 shall be assessed against the account and property served by the meter and/or seal tampered with, and the Village shall have the right to rebill the account for the previous 24 months based upon the difference between the amount previously billed and the average amount of water typically consumed by properties of similar use and occupancy. In addition, any violation of this regulation shall be grounds for termination of water service to the premises. In the event of such termination of service, service will not be restored until such time as all charges imposed against the account, including, but not necessarily limited to those charges herein set forth, have been paid as provided in §
176-11 of the Code.
A charge of $25 will be assessed for the requested
reading of a meter at any time other than a regularly scheduled meter
reading.
