No person shall swim or bathe in the waters
of, in or bounding the Borough of Medford Lakes unless such person
shall be suitably and decently attired.
No person shall swim or bathe in the waters
of, in or bounding the Borough of Medford Lakes while under the influence
of intoxicating liquor.
No person shall swim or bathe in the waters
of, in or bounding the Borough of Medford Lakes from any beach or
dam or appurtenances thereto between the hours of 9:00 p.m. and 7:00
a.m. of the following day.
All persons swimming or bathing in the waters
of, in or bounding the Borough of Medford Lakes between the hours
of 9:00 p.m. and 7:00 a.m. shall conduct themselves with due regard
to the rights of others, and without limiting the generality of the
above provision, no person so swimming or bathing during the hours
aforesaid shall make any loud or objectionable noise or sound such
as would disturb the rest of others.

Any person, firm, corporation, association or legal party whatsoever who or which shall violate, or authorize or procure a violation, or cause to be violated, any provision of this chapter shall, upon conviction thereof, be punishable as provided under the general penalty provisions found at §
1-15 of this Code. This, however, shall not apply against any municipal employee or officer that authorizes action by permit or otherwise in the ordinary course of their duties.

The purpose of this article is to regulate swimming,
boating, and the use of waterways, in or bounding the Borough of Medford
Lakes, including the means by which the waterways are preserved. The
purpose of this article is also to regulate the use of recreational
property within the Borough of Medford Lakes.
The following definitions shall apply:
LITTER
Garbage, refuse, and rubbish, or any type of waste material,
which, if thrown or deposited as herein prohibited, creates or is
likely to create a danger to public health, safety and welfare.
PERSON
Any person or persons, firm, association, partnership, club
or corporation.
RECREATIONAL PROPERTY
Any property, be it public, private, or quasi-public, utilized
for recreational purposes, including, but not limited to, beaches,
parks, playgrounds, golf courses, and athletic fields.
SPILLWAY
That portion of a dam which conducts the passage of water
from waterway to waterway.
TAMPER
To meddle, damage, misuse, alter, or otherwise interfere
with proper use.
WATER CONTROL DEVICE
The gates, gate boards, locking devices and grates at the
beginning of a spillway, that are used to control the flow of water
and debris passing through a spillway.
WATERCRAFT
Any boat or vessel for traveling on water.
WATERFOWL
Those species of birds, commonly known as swans, geese, Canadian
geese, brants, ducks, river ducks and sea ducks, and any other waterfowl
commonly found in or near the waterways of the Borough of Medford
Lakes.

WATERWAY
Any body of water within or bounding the Borough of Medford
Lakes.
It shall be unlawful for any person to tamper
with any water level control device located within the Borough of
Medford Lakes, be it on public, private or quasi-public property.

It shall be unlawful for any person (except
those authorized by the Borough of Medford Lakes, or by the Medford
Lakes Colony Club for maintenance, emergency or waterway bottom preservation
or treatment purposes) to operate, use, or in any manner, place in
any of the waterways located within or bounding the Borough of Medford
Lakes any watercraft or vessel which is temporarily or permanently
equipped with machinery for propulsion, to include, but not be limited
to, jet motors, air motors, outboard motors, or electric motors. This
section shall also be applicable to miniatures, or models, of vessels
or watercraft. This section shall not affect or include vessels propelled
wholly by sails or by muscular power.
It shall be unlawful for any person to start
a fire on any recreational property within the Borough of Medford
Lakes, without the prior express approval of the owner, governmental
body, private club, or organization or person having control over
such area.

It shall be unlawful for any person to:
B. Create any condition, or allow any condition to exist,
which results in a congregation or congestion of waterfowl which:
(1) Results in an accumulation of waterfowl feces or droppings;
or
(2) Results in damage to flora, fauna, or private or public
property; or
(3) Results in a threat to the public health, safety or
welfare; or
(4) Results in a threat to the health, safety or welfare
of said waterfowl.
