For the purpose of the Town of Cazenovia's Code of Ethics, the following terms shall have the meanings indicated:
INTEREST
A pecuniary or material benefit accruing to a municipal officer or employee as a result of a contract with the municipality which such officer or employee serves. A municipal officer or employee shall be deemed to have an interest in the contract of:
A. 
His or her spouse, minor children and dependents, except a contract of employment with the municipality which such officer or employee serves.
B. 
A firm, partnership or association of which such officer or employee is a member or employee.
C. 
A corporation of which such officer or employee is an officer, director or employee.
D. 
A corporation, any stock of which is owned or controlled directly or indirectly by such officer or employee.
MUNICIPAL OFFICER OR EMPLOYEE
An officer or employee of the Town of Cazenovia, whether paid or unpaid, including members of any administrative board, commissions or other agency thereof. No person will be deemed to be a municipal officer or employee solely by reason of being a volunteer fireman or civil defense volunteer.
No Town of Cazenovia officer or employee shall have any interest, financial or otherwise, direct or indirect, or engage in any business transaction or professional activity or incur any obligation of any nature which is in substantial conflict with the proper discharge or his or her duties in the public interest.
Every officer or employee of the Town of Cazenovia shall be subject to and must abide by the following standards of conduct:
A. 
No Town employee shall accept other employment which will impair his or her independence of judgment in the exercise of his or her official duties.
B. 
No Town employee shall accept employment or engage in any business or professional activity which will require him or her to disclose confidential information which he or she has gained by reason of his or her official position or authority.
C. 
No Town employee shall use or attempt to use his or her official position to secure unwarranted privileges or exemptions for himself or others.
D. 
No Town employee shall engage in any transaction as representative or agent of the Town with any business entity in which he or she has a direct or indirect financial interest that may reasonably conflict with the proper discharge of his or her official duties.
E. 
A Town employee may not imply or express that any person can improperly influence him/her or unduly enjoy his or her favor in the performance of his or her official duties.
F. 
Each Town employee shall abstain from making personal investments in enterprises which he or she has reason to believe may be directly involved in decisions to be made by him or her or which will otherwise create substantial conflict between his or her duty in the public interest and his or her private interest.
G. 
Each Town employee shall endeavor to pursue a course of conduct which will not raise suspicion among the public that he or she is likely to be engaged in acts that are in violation of his or her trust.
H. 
No Town employee employed on a fulltime basis nor any firm or association of which such employee is a member nor corporation a substantial portion of the stock of which is owned or controlled directly or indirectly by such employee shall sell goods or services to any person, firm, corporation or association who or which is licensed or whose rates are fixed by the Town in which such employee serves or is employed.
I. 
Each Town employee shall, to the extent that he or she is cognizant thereof, disclose any interest he or she may have in legislation before the Town Board.
J. 
No Town employee within two years after the termination of his or her service or employment with the Town shall accept employment which will involve contacts with the Town which can work to his or her special advantage by virtue of his or her prior contact and relationship with the Town.
K. 
An officer or employee may not directly or indirectly solicit any gift or accept or receive any gift having more than nominal value, whether in the form of money, services, loan, travel, entertainment, hospitality, thing or promise or any other form, under circumstances in which it could reasonably be inferred that such gift was intended to influence the officer or employee or could reasonably be expected to influence the officer or employee in the performance of official duties or was intended as a reward for any official action on the officer's or employee's part;
A. 
Nothing herein shall be deemed to bar or prevent the timely filing by a present or former municipal officer or employee of any claim, account, demand or suit against the Town of Cazenovia, or any agency thereof on behalf of the officer or employee or any member of his or her family arising out of any personal injury or property damage or for any lawful benefit authorized or permitted by law.
B. 
In addition to any penalty contained in any other provision of law, any person who shall knowingly and intentionally violate any of the provisions of this Code may be fined, suspended or removed from office or employment, as the case may be, in the manner provided by law.
