This Chapter 130 shall be known and cited as the "Sewers and Sewage Disposal Law" of the Town of Cazenovia.
The purpose of this chapter is to provide for the maximum beneficial public use of the Town of Cazenovia's public and private sewers and facilities through the regulation of the Town of Cazenovia Water Pollution Control Facility, the Town's public and private sewer system, the installation and connection of new sewers, the discharges of waters and wastes in the public sewer system, the quantity and quality of discharge wastes, pretreatment standards, equitable distribution of costs, issuance of discharge permits and penalties and procedures in cases of violation of this chapter.
The specific purposes of this chapter are the following:
A. 
To prevent the introduction of substances into the publicly owned treated works ("POTW") that will:
(1) 
Interfere with the POTW in any way;
(2) 
Pass through the POTW to the state's waters and cause contravention of standards for those waters or cause violation of the POTW's SPDES permit;
(3) 
Increase the cost or otherwise hamper the disposal of POTW sludge and/or residuals;
(4) 
Endanger municipal employees;
(5) 
Cause air pollution or groundwater pollution, directly or indirectly;
(6) 
Cause, directly or indirectly, any public nuisance condition.
B. 
To prevent new sources of infiltration and inflow and, as much as possible, eliminate existing sources of infiltration and inflow.
C. 
To assure that new sewers and connections are properly constructed.
D. 
To provide for the fair and equitable distribution to all users of the POTW of all costs associated with sewage transmission, treatment, and residuals disposal and to provide for the collection of such costs.
A. 
Over the course of approximately four decades, the Town of Cazenovia formed, in accordance with New York State law, over 21 sewer districts and extensions to prevent contamination of water supplies within the Town and to provide for the health, safety and general welfare of the Town of Cazenovia and adjacent communities by collecting and transporting wastewater from the community's neighborhoods to the Madison County Wastewater Treatment Facility.
B. 
Due to the proliferation of sewer districts and extensions thereof within the Town, it was recognized that the Town would benefit from the creation of a single unified consolidated sewer district encompassing all of the previous 21 sewer districts and extensions. Accordingly, through the attainment and administration of a local government efficiency grant, the Town effectively consolidated the various sewer districts into a single consolidated sewer district known as the "Town of Cazenovia Consolidated Sanitary Sewer District."
C. 
It was determined by the Madison County Board of Supervisors that the County of Madison should transfer the ownership, administration and operation of the Madison County Wastewater Treatment Facility and the corresponding sewer system. The County of Madison sought an appropriate governmental entity to which the county could transfer the entirety of the assets, property, dedicated funds and other financial interests of the sewer district as well as the responsibility of ownership, management, operation and maintenance of the treatment facility and main trunk line interceptor sewers. After careful thought and consideration, it was determined by the County of Madison, Town of Cazenovia, Village of Cazenovia, and Town of Nelson that the assets of the Madison County Sewer District, including the treatment facility, main trunk lines and appurtenances, should be transferred to the Town of Cazenovia.
D. 
In order to accomplish the lawful and efficient dissolution and transfer of the Madison County Sewer District, the County of Madison, Town of Cazenovia, Village of Cazenovia and Town of Nelson sought the passage of special legislation from the New York State Legislature to effectuate the dissolution and transfer. Special legislation was drafted and thereafter duly introduced and passed by the New York State Senate on May 25, 2016, and the New York State Assembly on June 14, 2016, and signed by the Governor on November 14, 2016.
E. 
The special legislation dissolved the Madison County Sewer District in its entirety effective upon the execution of an intermunicipal agreement for the management, maintenance, operation, billing, financing and future infrastructure and capital improvements of the Town of Cazenovia Water Pollution Control Facility and corresponding sewer system formerly known as the "Madison County Sewer District." Said intermunicipal agreement was executed by all the necessary parties, thereby effectuating the dissolution of the Madison County Sewer District and the transfer of its assets and liabilities to the Town of Cazenovia. As the owner and operator of the Town of Cazenovia Water Pollution Control Facility and corresponding sewer system, the Town of Cazenovia is enacting this chapter to ensure the protection of the control facility, the corresponding sewer system and the health, safety and welfare of the public.
