Each owner of property in the Village of Hewlett Neck
shall maintain and care for or replace any shrubs or plantings in
the area of a public right-of-way adjoining such property and located
between such owner's property and the paved area of any public street
or road in such adjoining right-of-way.
Without prior permission of the Village of Hewlett
Neck, no person shall erect or place any fixtures, structures or materials
in the area of a public right-of-way located between the area of any
public street or road and the boundary of any adjoining property.
Where the Board of Trustees has reason to believe
that any person has violated any provision of this section, the Board
of Trustees may give written notice to such person, in such manner
as may be determined by the Board of Trustees, to appear before the
Board of Trustees to be heard in connection with such matter and with
respect to any remedies which the Board of Trustees may elect pursuant
to this section. After such appearance, the Board of Trustees may
determine that such person is in violation of a provision of this
section and may require such person to take such action as may be
determined by the Board of Trustees to be appropriate to remedy said
violation. If such person fails to complete such action within the
time specified therefor by the Board of Trustees, the Board of Trustees
may direct that the Village perform such action and that the cost
of such performance shall be reimbursed to the Village by each such
person, together with the costs incurred by the Village, including
legal expenses, for collection of such reimbursement. If any such
person is an owner of real property in the Village, the amount of
such reimbursement shall be assessed against such real property and
collected in the same manner as provided for assessment and collection
of taxes on real property. The remedies provided in this subsection
shall be in addition to any other penalties which may be applicable
by law for any violation of this section.
