Buildings occupied, in whole or in part, as defined in this Part 1 shall comply with the requirements hereinafter set forth concerning occupancy, size, light and ventilation in order to provide a safe and healthful environment.
Buildings for the purpose of this Part 1 shall be classified in respect to their occupancies as follows:
A. 
One- and two-family dwellings: buildings containing one or two dwelling units.
B. 
Multiple dwellings: as defined in § 215-6.
In dwelling units other than one- and two-family dwellings, the maximum number of occupants shall be limited to the number determined on the basis of the floor areas of habitable rooms, other than kitchens, as follows:
A. 
One occupant per room having a floor area of at least 70 square feet, two occupants per room having a floor area of at least 120 square feet, and three occupants per room having a floor area of at least 180 square feet.
B. 
In every dwelling unit every room occupied for sleeping purposes by one occupant shall have a minimum gross floor area of at least 70 square feet. Every room occupied for sleeping purposes by more than one occupant shall contain at least 50 square feet of floor area for each occupant thereof.
C. 
In lodging units, the maximum number of occupants shall be limited to the number determined on the same basis as for dwelling units.
D. 
In buildings occupied as clubs, dormitories and sorority or fraternity houses and providing sleeping accommodations for more than five persons, the maximum number of occupants so accommodated in any habitable room shall be limited to the number determined on the basis of the floor area, in square feet, of the room divided by 50 square feet per occupant.
A. 
It shall be prohibited to use for regular sleeping purposes any kitchen, nonhabitable space or public space.
B. 
It shall be prohibited in lodging houses to use for dining purposes any communal kitchen containing less than 60 square feet of floor area or any nonhabitable space or any public space other than a dining area.
C. 
It shall be prohibited to use any cellar space as habitable space unless improved with concrete floors and permanent wall coverings kept waterproof and permanently drained and provided with two exits not located in the same wall.
The basement or cellar of any building shall be free from standing water. It shall be ventilated and free of garbage and/or refuse accumulation or infestation.
A. 
Habitable space.
(1) 
Habitable space shall be provided with natural light through one or more windows, skylights, transparent or translucent panels, or any combination thereof, that face directly on legal open spaces above the adjoining finished grade or are above a roof.
(2) 
Habitable space shall be provided with electric light.
(3) 
Habitable space shall be provided with natural ventilation through openable parts of windows or other openings in exterior walls that face legal open spaces above the adjoining finished grade or above a roof or through openable parts of skylights.
(4) 
Habitable space may also be provided with mechanical ventilation, in addition to natural ventilation.
B. 
Public space.
(1) 
Public spaces shall be provided with electric light.
(2) 
In public stairs, stairways and passageways and porches, artificial light shall be electric lighting available at all times so as to afford safe passageway for occupants and users.
(3) 
Public spaces shall be provided with either natural ventilation conforming to the requirements for habitable space or with mechanical ventilation as set forth in the New York State Uniform Fire Prevention and Building Code, and any other amendments thereto.
A. 
Toilet rooms and bathrooms. Toilet rooms and bathrooms in one- and two-family dwellings shall have provisions for privacy.
B. 
No person shall occupy as owner-occupant or let to another for occupancy any dwelling unit for the purpose of living, sleeping, cooking or eating therein which does not comply with the following requirements:
(1) 
Sanitary facilities. The following minimum sanitary facilities shall be supplied and maintained in a sanitary and safe working condition:
(a) 
Water closets. Every dwelling unit shall contain within its walls a room, separate from the habitable rooms, which affords and which is equipped with a water closet.
(b) 
Lavatories. Every dwelling unit shall contain a lavatory, which, when a closet is required, shall be in the same room with said water closet.
(c) 
Bathtubs or showers. Every dwelling unit shall contain a room which affords privacy to a person in said room and which is equipped with a bathtub or shower. Toilet rooms for employees in multiple dwellings shall be separate rooms for each sex where there are five or more employees, shall be readily accessible to such employees and shall not open directly into any public kitchen or other public space used for the cooking or preparation of food. In all dwellings, bathrooms and toilet rooms shall be provided with floors of moisture-resistant material.
(2) 
Light and ventilation.
(a) 
Kitchenettes, bathrooms and toilet rooms shall be provided with electric light approved for the use of such rooms.
(b) 
Laundry rooms, furnace rooms and similar nonhabitable space shall be provided with electric light approved for the intended use of such rooms.
(c) 
Stairs shall be provided with electric light to allow safe ascent or descent.
(d) 
Kitchenettes, bathrooms and toilet rooms shall be provided with ventilation.
A. 
Stairs, both interior and exterior, shall be of sufficient width in conformity with generally accepted standards so as to serve the occupants.
B. 
Railings shall be provided on all interior stairways and open portions of stairs, balconies, landings and stairwells. Such railings must be well-secured and extended the full length of the stairway.
A. 
Safe, continuous and unobstructed exit shall be provided from the interior of the building to the exterior.
B. 
Exits shall be arranged, constructed and proportioned so that occupants may escape safely from the building in case of emergency.
C. 
In one- and two-family dwellings, in addition to a primary exit from the building, there shall be provided a secondary exit or, in lieu thereof, one or more exit openings for emergency use.
D. 
In multiple dwellings, exits shall be provided in conformance with the Multiple Residence Law of the State of New York.
A. 
Dwelling units shall be separated from each other.
B. 
Sleeping rooms within dwelling units shall be separate from each other.
C. 
Lodging units shall be separated from each other.
