A. 
As used in this chapter, all words and phrases defined in Article 1 of the Vehicle and Traffic Law are included and made a part of this chapter.
B. 
In addition to the terms defined in Article 1 of the Vehicle and Traffic Law, for the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:
CONGESTED DISTRICT
Includes the public streets and places bounded as follows:
(1) 
North by the north side of Sixth Street from the east side of Lafayette Street to the east side of Prendergast Avenue.

(2) 
South by the south side of Steele Street, Washington Street Bridge Arterial and Allen Street from the west side of Sprague Street to the east side of Foote Avenue.
(3) 
East from the northeast corner of Prendergast Avenue and East Sixth Street to the south side of East Fifth Street to the east side of Church Street to the north side of East Fourth Street to East Second Street, then crossing to the south side of East Second Street and going west to the intersection of the extension of the east side of Foote Avenue and the south leg of Allen Street.
(4) 
West from the northeast corner of Lafayette Street and West Sixth Street to the north side of West Fifth Street to the east side of Jefferson Street to the north side of West Third Street to the northeast corner of West Third Street and Andrews Avenue to the southeast corner of West Third Street and Andrews Avenue to the east end of the Third Street Bridge to the western side of the intersection of Sprague Street and Steele Street.
Upon the trial of any action or proceeding arising out of acts alleged to have been committed in violation of this chapter or the Vehicle and Traffic Law of the state, the City Court may admit evidence of speed readings shown on the speed indicator of an electronic radar device upon proof that the accuracy of such device was tested against a calibrated speedometer within a twenty-four-hour period immediately preceding the taking of such readings.
A. 
It is a traffic infraction for any person to violate any of the provisions of this chapter or of any local law, ordinance, order, rule or regulation adopted pursuant to this chapter unless such violation is, by this chapter or other law of this state, declared to be a misdemeanor or felony.
B. 
Every person convicted of a traffic infraction for a violation of any of the provisions of this chapter, for which another penalty is not provided, shall:

(1) 
For a first conviction thereof be punished by a fine of not less than $50 or by imprisonment for not more than 15 days, or by both such fine and imprisonment.
(2) 
For a conviction of a second violation, both of which were committed within a period of 18 months, such person shall be punished by a fine of not less than $100 or by imprisonment for not more than 15 days, or by both such fine and imprisonment.
(3) 
Upon a conviction of a third or subsequent violation, all of which were committed within a period of 18 months, be punished by a fine of not less than $250 or by imprisonment for not more than 15 days, or by both such fine and imprisonment.
C. 
Any person violating any of the provisions of §§ 290-14 through 290-17 of this chapter pertaining to traffic signal lights shall:
(1) 
Upon a first conviction thereof, be punished by a fine of not less than $50 nor more than $150 or by imprisonment for not more than 15 days, or both.
(2) 
For a conviction of a second violation, both of which were committed within a period of 18 months, such person shall be punished by a fine of not less than $150 nor more than $250 or by imprisonment of not more than 15 days, or both.

(3) 
For a conviction of a third or subsequent violation, all of which occurred within a period of 18 months, such person shall be punished by a fine of not less than $250 nor more than $450 or by imprisonment for not more than 15 days, or both.

D. 
Any person violating any of the provisions of § 290-12 of this chapter relating to speed of motor vehicles, upon conviction of a first violation, shall be punished as follows:
(1) 
Where the court or tribunal records or enters that the speed upon which the conviction was based exceeded the applicable speed limit by not more than 10 miles per hour, by a fine of not less than $30 nor more than $100.
(2) 
Where the court or tribunal records or enters that the speed upon which the conviction was based exceeded the applicable speed limit by more than 10 miles per hour but not more than 30 miles per hour, by a fine of not less than $60 nor more than $200 or by imprisonment for not more than 15 days, or by both such fine and imprisonment.
(3) 
Where the court or tribunal records or enters that the speed upon which the conviction was based exceeded the applicable speed limit by more than 30 miles per hour, by a fine of not less than $120 nor more than $400 or by imprisonment for not more than 15 days, or by both such fine and imprisonment.

(4) 
Notwithstanding the foregoing provisions of this subsection, the maximum fine provided herein for the violation for which the person is sentenced may be increased by an additional $100 if the conviction is for a second violation of any subsection of this section and both violations were committed within an eighteen-month period, and the maximum fine provided herein for the violation for which the person is sentenced may be increased by an additional $250 if the conviction is for a third or subsequent violation of any subdivision of this section where all such violations were committed within an eighteen-month period. Where an additional fine is provided by this subsection, a sentence of imprisonment for not more than 15 days may be imposed in place of or in addition to any fine imposed.
