From and after the enactment of this chapter, upon completion of the requirements as provided in Article XIV of the Second Class Township Code, the owner or owners of any lot, parcel, tract of land or premises fronting or abutting on an affected public street, road or avenue, within the Township of Exeter, upon which a grade has heretofore or hereafter shall be established shall, upon receipt of written notice from the Township, at their respective costs and expenses, construct, repair and maintain the curbing, sidewalk and driveways in front of and along the property owed by them, and complete fully the same within 90 days after the notice is given.

The Board of Supervisors of the Township, or any officer or employee of the Township designated thereby for the purpose, is hereby authorized to give the aforementioned notice in any one of the following ways:
A. 
By personal delivery of the notice to the owner, tenant, or lessee of the premises;
B. 
By leaving the notice with an adult upon the premises;
C. 
By attaching a copy of the notice to the door at the entrance of the premises in violation; or
D. 
By mailing, by certified mail, the notice to the last known address of the owner of the premises.

Upon failure of any owner or owners to comply with the provisions of this chapter and to complete fully such construction, repair, and maintenance within 90 days of the date of the notice, the Township shall enter upon and construct, repair, and/or maintain required curbing, sidewalks, and/or driveways, and the exact cost thereof may be collected by the Township from such person in any manner provided by law.
A. 
Curbs and sidewalks shall be laid out and constructed in conformity with the lines and grades of the street established by the Board of Supervisors.
B. 
Lines and grades shall be staked out on the ground at the owner's expense by a registered engineer or surveyor or shall be staked out by the Township's Surveyor and the appropriate fee charged in accordance with the Township Fee Schedule.
C. 
New construction may conform to lines and grades of existing adjacent curbs and sidewalks which are in good condition, subject to approval by the Township Engineering Department.
A. 
All curbs shall be concrete, 24 inches deep, seven inches wide at the top and eight inches wide at the bottom, the back face being vertical and the front face having a uniform batter of one inch and a reveal of seven inches above final grade. Both top corners shall have a three-quarter-inch radius. All curbs shall have a minimum four-inch depth of crushed aggregate stone base (AASHTO No. 57).
B. 
Curb forms shall be stripped as soon as the concrete has set, and concrete shall be rubbed while still green.
C. 
Curbs shall be cast in sections with one-half-inch premolded expansion joints every 20 feet and control joints every 10 feet.
D. 
In the case of slip-formed curb, one-half-inch premolded expansion joints shall be required every 50 feet, with control joints every 10 feet.
E. 
Curbs shall be cast separately from driveway aprons and sidewalks, with one-half-inch premolded expansion joints where curbing and sidewalk abut each other.
F. 
Curbs placed across driveways shall be reduced in height from seven inches above final grade to 1 1/2 inches, reverting at each end to full height by a reverse vertical curve at a distance of two feet.
G. 
Curbs placed across ADA curb ramps shall be reduced in height from seven inches above final grade to zero inches, reverting at each end in a distance of six feet.
H. 
Straight forms shall not be used on curbs unless authorized by the Township Engineer.
I. 
When installing curbs on existing streets, the existing pavement shall be cut straight prior to excavation.
J. 
All excavated material shall be removed from the cartway by the end of each working day.
K. 
Curbs shall be tied into catch basins with reinforcing bars to prevent settlement of the curb.
L. 
Rain conductors in curbs shall be no more than one inch below the top of curb, to allow for future resurfacing of the street.
M. 
Depressed curbs at driveway entrances shall have two No. 5 reinforcing bars installed.
A. 
Sidewalks shall be concrete, not less than four feet wide and five inches thick, placed on a five-inch minimum depth of crushed aggregate stone base (AASHTO No. 57).
B. 
A nonskid finish shall be used.
C. 
Sidewalks shall be cast separately from curbs and driveway aprons.
D. 
The grass strip between the curb and sidewalk shall not be less than four feet wide. Property owners shall be responsible for maintenance of the grass and the area between the sidewalks and the right-of-way line.
E. 
Sidewalks and grass strips shall slope toward the curb at 1/4 inch per foot.
F. 
ADA curb ramps shall be installed in accordance with the federal Americans with Disabilities Act, state laws and local ordinances. ADA ramps are to be constructed with pedestrian warning devices for the visually impaired. Specifications shall conform to labor and industry standards.
A. 
Concrete driveway aprons shall be placed between the curb and sidewalk. Aprons may be eight inches of plain concrete or six inches of mesh-reinforced concrete on a five-inch minimum depth of crushed aggregate stone base (AASHTO No. 57).
B. 
The driveway behind the sidewalk may be concrete, macadam or crushed stone.
C. 
Driveway aprons shall be cast separately from the curb and sidewalk.
D. 
Where there are no sidewalks, driveways may be extended to the curb or to the street using concrete, macadam or gravel.
E. 
Driveways with grades greater than 10% shall be paved.
F. 
Pipes shall not be used to convey stormwater under driveways.
G. 
The driveway approach shall be depressed to allow water to flow unimpeded down the shoulder, gutter or swale, whether existing or proposed.
H. 
Exceptions may be made on a case-by-case basis where the shoulder, gutter or swale is so deep as to make it impractical to depress the driveway, subject to review by the Township Engineer and supporting calculations.
I. 
It shall be the owner's responsibility to grade the driveway to avoid scraping.
A. 
Concrete for curbs, sidewalks and driveways shall have a twenty-eight-day compressive strength of not less than 3,500 pounds per square inch and shall be air-entrained.
B. 
All concrete work shall be covered for 72 hours or sprayed with curing compound to prevent loss of moisture.
C. 
No concrete work shall be placed on frozen, wet or yielding ground.
D. 
When freezing temperatures are expected within the next five days, concrete work shall be protected with insulation.
A. 
Trees and shrubbery shall not be placed between the curb and sidewalks.
B. 
Trees and shrubs shall be planted at least one foot behind the right-of-way line, outside the required sight triangles, 30 feet from street intersections, 15 feet from driveways and alleys, 10 feet from utility poles and 10 feet from sewer lines.
C. 
Shade trees that are planted to satisfy Chapter 330, Subdivision and Land Development, requirements shall be planted at least one foot, but not more than five feet, behind the right-of-way line, not more than 50 feet apart, and shall be at least 2 1/2 inches in caliper and eight feet in height.
D. 
Approved shade tree species are those tree species listed in Chapter 348, Trees, § 348-9, and all appendices thereto.

E. 
Additional species may be approved, from time to time, by the Township Environmental Advisory Council and Planning Commission.
F. 
No more than 1/3 of the trees planted in the subdivision or development to satisfy Chapter 330, Subdivision and Land Development, requirements shall be of the same species.
G. 
Shade trees shall be planted prior to the property being transferred from the builder or developer to the owner.
