This article shall be applicable to all territory within the
limits of the Town of Neversink.
It shall be lawful for any authorized organization, defined
in § 476, Article 14-H, of the General Municipal Law of
the State of New York, the Bingo Licensing Law, to conduct the game
of bingo within the territorial limits of the Town of Neversink, upon
obtaining a license, subject to the provisions of this article, Article
14-H of the General Municipal Law, Article 19-B of the Executive Law,
the Bingo Control Law, and rules and regulations adopted by the State
Lottery or Bingo Control Commission, pursuant to State Lottery or
Bingo Control Laws, and amendments to said laws. Any inconsistency
between this article and said statutes shall be resolved in favor
of those statutes.

The conduct of bingo games authorized by this article shall
be subject to the restrictions set forth in § 479 of the
General Municipal Law, as the same may be amended from time to time.
Games of bingo may be conducted in the Town of Neversink on
Sunday, provided that the license to conduct such game so specifies.
Limited-period bingo, defined in § 476, Subdivision
10, of the General Municipal Law, may be conducted in accordance with
the provisions of this article.
The provisions of the Bingo Licensing Law and the provisions
of the State Lottery or Bingo Control Law, at the time of the adoption of this article, shall control
the licensing of organization and the conduct of bingo games in the
Town of Neversink. This article incorporates said provisions by reference
as if set forth in full herein.
In accordance with § 498 of the General Municipal
Law, the Town Board hereby designates to the Town Clerk any authority
granted to it in relation to the issuance, amendment and cancellation
of licenses; the conduct of investigations and hearings; the supervision
of the operation of the games; and the collection and transmission
of fees.
The making of any false statement in any application for a license,
in any statement annexed thereto or any other violation of the provisions
of said Article 14-H of the General Municipal Law or any violation
of the terms of such a license shall constitute a misdemeanor and
shall subject the offender to forfeiture.
This Article shall become effective:
A. Upon
approval of the same by a majority of the qualified electors of the
Town of Neversink voting on a proposition therefor, duly submitted
at a general or special election held within the town as provided
by law; and
B. Upon
filing with the State Lottery Control Commission a copy of such Article
within 10 days after its adoption as above provided.

This Article shall be applicable to all territory within the

Article 9-A, § 186, of the General Municipal Law of the
State of New York (the "Games of Chance Licensing Law") to conduct
games of chance within the territorial limits of the Town of Neversink,
upon obtaining a license therefor, subject to the provisions of this
Article, subject to the Games of Chance Licensing Law and subject
to rules and regulations adopted by the New York State Racing and
Wagering Board and amendments to said laws and regulations. Any inconsistency
between this Article and said statutes and regulations shall be resolved
in favor of those statutes and regulations.
The conduct of games of chance authorized by this Article shall
be subject to the restrictions imposed by Section 189 of the Games
of Chance Licensing Law.
Games of chance may be conducted in the Town of Neversink on
Sunday, provided that the license to conduct such games so specifies.
The Sheriff of the County of Sullivan shall exercise control
over and supervision of all games of chance conducted under duly authorized
license. The Sheriff of the County of Sullivan shall have all those
powers and duties set forth in and for the enforcement of Article
9-A of the Games of Chance Licensing Law.
This Article shall become effective:
A. Upon approval of the same by a majority of the qualified electors
of the Town of Neversink voting on a proposition therefor duly submitted
at a general or special election held within the town pursuant to
the provisions of the Municipal Home Rule Law; and
B. Upon filing with the Secretary of State.
