This article is enacted under authority of the Second Class
Township Code as amended, 1963, July 30, P.L. 352, § 1;
1967, June 16, P.L. 108, § 1 (53 P.S. § 65703).
This article is enacted to place, replace, operate, maintain
and repair fire hydrants and to provide for or acquire a water supply
system equipped to supply sufficient water for protection and safety
of the citizens and property of the Township of Unity from fire.
To pay the cost and expense for such fire protection service,
an assessment shall be made on all property, whether or not exempt
from taxation under existing law, abutting upon any highways, streets,
roads or alleys or portions thereof within 780 feet of any fire hydrant
in the district benefited thereby and in proportion to the number
of feet the said property fronts on any highway, street, road or alley
upon which a water main is laid or within 780 feet of any fire hydrant
on such highway, street, road or alley. The assessment shall be 0.00023
mills based on a 100% assessment on all surfaced properties for real
estate located within such seven-hundred-eighty-foot radius of the
fire hydrant.
The Tax Collector shall collect and receive the assessment,
plus interest, fines and penalties, imposed by this article and shall
maintain records showing the amounts received and the dates such amounts
were received. The Tax Collector shall prescribe and issue all forms
necessary for the administration and assessment collection. The Tax
Collector is to be paid in the same fashion as his contractual obligation
with the Township for the collection of taxes.

Any person who shall fail or refuse to make any payment required
under this article shall, when found by the District Justice to have
so violated this article, be subject to a civil fine not to exceed
$600 for each offense, plus all court costs and reasonable attorneys'
fees incurred by Unity Township in the enforcement of this article
in a civil enforcement proceeding. Each violation shall constitute
a separate enforceable offense punishable by a like civil fine for
each day of continued violation.
This article shall become effective on February 20, 1985, and
shall continue on a calendar-year basis without annual reenactment.
