The legislative body of the Town of Malta finds
that:
A. The Town Board of the Town of Malta must periodically
amend, modify or supplement the various chapters of the Town Code
of the Town of Malta.
B. Current New York State law (§§ 264
and 265 and other sections of the Town Law) requires that after a
local law is adopted, the entire law must be published in the official
periodical of the municipality for said law to be valid.
C. The New York State Municipal Home Rule Law § 1
et seq. permits a municipality to adopt a law which legislates that
an abstract or summary of the law be published rather than the entire
law, provided that the same gives adequate notice to the public.
D. The Town Board believes that an abstract or summary
will provide proper legal notice to the public, while at the same
time reducing unnecessary expenditures by the Town.
This Article does not prohibit the Town Board
from publishing the local law in its entirety if it believes, in its
absolute legislative discretion, that such publication is necessary
or beneficial to the public.
The purpose of this article is to amend the
requirements of the laws of New York State for publication of the
full text of a Town ordinance to effectuate such ordinance.
This Article is enacted pursuant to the authority
vested in the Town of Malta by the Town Law, the Municipal Home Rule
Law, the Executive Law and other applicable laws of the State of New
York.
Sections 133, 264 and 265 of the Town Law, which
require publication of the full text of all ordinances adopted by
a town, are hereby amended to the extent that they relate to any and
all proceedings of the Town Board of the Town of Malta, Saratoga County,
New York, to provide that any and all ordinances enacted pursuant
to the provisions of said sections of the laws of the State of New
York shall become effective by publication in the official Town newspaper
of said Town of a summary describing the subject matter of such ordinance,
together with a notice stating that the whole of such ordinance is
on file with the Town Clerk of said Town during the period of such
publication, in lieu of the publication of the entire text of such
ordinance as heretofore required by said sections of the Town Law.
