This article shall be known as the "Town of Brookhaven Office of the Town Council Law."
A. 
Word usage. Whenever used in this article, words used in the singular include the plural and vice versa.
B. 
Definitions. As used in this article, the following terms shall have the meanings indicated:
COUNCILMEN
The public officials elected as Councilmen of the Town of Brookhaven. The provisions of Subdivision 5-a of § 20 of the Town Law are deemed included herein.
TOWN BOARD
The Supervisor and Councilmen.
TOWN COUNCIL
All of the Councilmen (six) elected as public officials.

A. 
The Town Board shall be the legislative, appropriating, governing and policy-determining body of the Town and shall have and exercise all such powers and duties as are conferred or imposed upon it or are necessarily incidental thereto which are consistent with the provisions of Article 3-A of the Town Law of the State of New York, entitled "Suburban Town Law."
B. 
General powers and duties.
(1) 
Legislative. As the legislative body of the Town, the Town Board shall be responsible for drafting and enactment of legislation as required for the efficient operation of the government of the Town of Brookhaven, as well as promoting the general welfare of the residents of the Town.
(2) 
Liaison. The members of the Town Council shall serve as liaison, as designated by the Supervisor, with the various officials, departments, divisions, bureaus and committees of the Town.[1]

(3) 
The Town Board may accept a purchase-money mortgage to secure payment of consideration in connection with the sale of municipal property. Such contract shall be approved by resolution of the Town Board and shall set forth the terms of such installment payments, including the rate at which interest shall be calculated. Nothing herein shall be construed to supersede or contradict any provisions of Town Law § 64(2).

C. 
Each Councilmember shall have the full power and authority to appoint and/or remove his/her legislative aide(s) and/or personal assistants.

Nothing herein contained shall be construed to delegate or transfer any power of the Town Supervisor contained in §§ 29, 52 and 125 of the Town Law of the State of New York or any other powers which may be lawfully exercised by said Supervisor.

A. 
A member of the Town Council's term of office, as elected by a majority of the Town of Brookhaven voters within each respective ward, shall be for four years until the next required election date.
B. 
A member of the Town Council may serve up to three four-year terms regardless of whether said terms are served consecutively or nonconsecutively.

If any section, provision or part thereof in this article shall be adjudged invalid or unconstitutional by a court of competent jurisdiction, such adjudication shall not affect the validity of the article as a whole or any section, provision or part hereof not as adjudged invalid or unconstitutional.
