This article shall be known as the "Town of
Brookhaven Office of the Superintendent of Highways Law."
As used in this article, the following terms
shall have the meanings indicated:
DEPUTY SUPERINTENDENTS
The Deputy Superintendents of the Office, who shall act generally
for and in place of the Superintendent.

OFFICE
The Town of Brookhaven Office of the Superintendent of Highways,
which shall perform a major function of Town government.
SUPERINTENDENT
The Superintendent of Highways, an elected position, who
shall be the chief executive officer of the Office.

A. There shall be in the Town of Brookhaven an Office
of the Superintendent of Highways. The principal executive officer
and administrative head of such office shall be the Superintendent
of Highways. The Superintendent or his designee shall have the powers
and duties of the Highway Superintendent, pursuant to the Highway
Law, and shall be the head of the office, with the power and authority
to appoint and remove employees under his jurisdiction in accordance
with the Civil Service Law and other applicable laws.
B. The Superintendent of Highways may appoint Deputy
Superintendents, who shall generally act for and in behalf of the
Superintendent, at such salary and for such term as may from time
to time be fixed by the Town Board, and who shall perform such duties
as may be directed by the Superintendent and as are vested in and
imposed upon that office by the provisions of this article, by statute
or by other lawful authority.
C. Term of office and term limits.

(1) The Superintendent of Highways' term of office, as elected by a majority
of the Town of Brookhaven voters, shall be for four years until the
next required election date.
(2) The Superintendent of Highways may serve up to three four-year terms
regardless of whether said terms are served consecutively or nonconsecutively.
The Superintendent shall have such powers as
shall be necessary for the proper administration of the Office, consistent
with applicable provisions of law. The powers and duties of the Office
of the Superintendent of Highways shall be under the administration,
direction and control of the Superintendent. Until such time as the
same may be either amended or modified, the Office shall be divided
into the following divisions:
A. Division of Highway, Road and Bridge Maintenance.
B. Division of Vehicle and Equipment Repair and Maintenance.
C. Division of Signage.

The functions, powers and duties of such divisions
herein shall be under the administration, direction and control of
the Superintendent of Highways and shall be as follows:
A. Division of Highway, Road and Bridge Maintenance.
This Division has charge and supervision of the construction, repair,
reconstruction, improvement, maintenance and snow removal for all
highways, roads, streets, sidewalks, bridges, municipal parking areas,
drains and drainage structures and bridges and boardwalks under Town
jurisdiction or any special districts thereof or other such duties
as may be assigned.
B. Division of Vehicle and Equipment Repair and Maintenance.
This Division has charge and supervision of and provides for the repair
and maintenance service for all vehicles and equipment owned by and
under the jurisdiction of the Town of Brookhaven Office of the Superintendent
of Highways or any of its special districts and manages and maintains
related facilities, equipment and personnel necessary for the proper
administration thereof.
C. Division of Signage. The powers and duties of said
Division shall be as follows: to administer, supervise, manage, implement,
initiate and direct all matters pertaining to the fabrication, installation
and maintenance of traffic control signs and pavement markings within
the Town.

D. Division of Traffic Safety and Streetlighting. The powers and duties
of said Division shall be as follows: to administer, supervise, manage,
implement, initiate and direct the planning of all matters pertaining
to traffic safety. Traffic safety matters shall be those pertaining
to traffic safety programs and operations within the Town and coordination
of the Town’s participation in traffic safety matters. The Division
shall be responsible to effectuate the nationally recognized concern
for improved transportation operations and highway safety; to propose
local laws, ordinances and rules and regulations relative to traffic
safety consistent with the laws of New York State as they relate to
the Town of Brookhaven; with Town Board approval, to design, install,
operate and maintain appropriate traffic control devices consistent
with Town policy; to implement and continue traffic safety, making
use of all Town departments and boards to accomplish this end; to
cooperate with all governmental and municipal agencies in establishing
traffic safety regulations; to collect, compile and maintain any and
all available data relative to traffic safety; to make available to
all governmental and municipal agencies traffic safety data, along
with analysis and interpretation, as necessary, to conduct educational
programs covering all aspects of traffic safety and make said programs
available to the general community; to try to encourage citizen participation
in all areas consistent with the Division’s area of responsibilities;
to coordinate the Town’s continuing role in the development
of a county-wide public transportation system and encourage citizen
involvement in the effectuation of that system; and to perform any
other planning or traffic-related functions as requested by the Town
Board or other Town departments. In conjunction with the foregoing,
this Division shall administer, supervise, manage, implement, initiate
and direct all matters pertaining to the installation, development
and maintenance of all streetlighting facilities within the Town-wide
Streetlighting District and to perform other related functions as
requested by the Town Board and other Town departments.

The Superintendent may establish a schedule
of fees to be collected by him for any service rendered in connection
with the work of his Office and for which he deems it necessary to
charge and collect a fee for matters authorized by statute or local
law.
All costs and expenses incurred by the Office
of Superintendent of Highways or its officers or employees on behalf
of a special improvement district or special Town project shall be
charged against such district or project and paid from the funds duly
appropriated for the purpose of such district or project.
Nothing herein contained shall be construed
to delegate or transfer any power of the Town Supervisor contained
in §§ 29, 52 and 125 of the Town Law of the State of
New York or other powers which may be lawfully exercised by said Supervisor.
