The final plat and supporting drawings and documents for a proposed subdivision constitute the complete development of the subdivision proposal and include the recommendations resulting from the Planning Board review of the preliminary layout as well as the detailed drawings for the public improvements. After public hearing and approval by the Planning Board, this complete submission, along with the performance bond, as approved by the Town Board, becomes the basis for the construction of the subdivision and the inspection service by the Planning Board. The plat itself must be filed in the County Clerk's office to have legal status. An unfiled plat is not a valid basis for site improvements or other commitments which depend on its design characteristics.
A. 
Submission of a final plan, before the Planning Board review, shall consist of the following items:
(1) 
An application for final plat approval, together with a filing fee as established by Town Board resolution.

(2) 
The final plat, six paper prints, including signed approval from the Suffolk County Department of Health.
(3) 
A final drainage plan and street profiles.
(4) 
Letters directed to the Chairman of the Planning Board and signed by a responsible official of the lighting agency, water company or any utility company or governmental authority which provides necessary utility service and has jurisdiction in the area approving each proposed utility installation design and a statement as to who will construct the facility.
(5) 
A letter directed to the Chairman of the Planning Board signed by a responsible official of the school district in which the subdivision is to be located acknowledging receipt of the subdivision plans.
(6) 
Dedication and easements:
(a) 
Deeds of dedication, surveys and a certificate of title, properly executed, for all properties, other than street rights-of-way, to be offered to the Town for dedication.
(b) 
Release and dedication of streets, application to lay out streets, proposed order of the Superintendent of Highways and proposed consent of the Town Board, all in triplicate and drawn in accordance with the provisions of § 171 of the Highway Law.
(c) 
Drainage easements.
(d) 
Easements of limited access and planting area. (Street dedication instruments are to be offered at the time of performance bond approval.)
(e) 
An easement permitting any cable television firm franchised by the Town of Brookhaven the right to install coaxial cable trunk distribution lines for cablevision, together with the necessary electronic equipment, without charge, provided that such installation is made in the same manner and at the same time as the installation of electric and telephone distribution lines. Such easement shall be effective immediately upon the filing of the map in the office of the Suffolk County Clerk and prior to the acceptance of the public improvements by the Town of Brookhaven. Such casements shall be in a form authorized by the Planning Board and approved by the Town Attorney.
B. 
The subdivider or his agent shall submit the final plat and supporting drawings and documents to the Planning Board office at least 15 days prior to the meeting date on which the plat is to be acted upon.
C. 
The Planning Board shall advertise a public hearing at least 10 days prior to the hearing date. The subdivider shall notify all adjoining owners at least 10 days before the public hearing and file with the Planning Board an affidavit giving the names of those notified and the date such notices were mailed.

D. 
After the public hearing, the Planning Board shall take formal action. If the plat is approved, the subdivider shall carry out the following steps prior to obtaining the Chairman's signature of approval:
(1) 
He shall make all required corrections to the satisfaction of the Planning Board.
(2) 
He shall submit the required performance bond to the Planning Board for checking and forwarding to the Town Board for approval.
(3) 
He shall pay the required inspection fee to the Planning Board and such payment, if required, in lieu of parklands.
(4) 
He shall prepare prints of the corrected final plat drawings as follows:
(a) 
Eight paper prints.
(b) 
Three opaque cloth litho prints; only one print shall be required on subdivisions already filed.
(c) 
One tracing cloth litho print.
(d) 
The original drawing.
(e) 
Three paper prints and the original of the corrected drainage plans and street profiles.
(f) 
One photographic reduction of the final plat on a scale of one inch equals 1,000 feet and one photographic reduction of the final plat on a scale of one inch equals 1,200 feet.
E. 
The subdivider shall file three opaque prints of the signed plat, not including the supporting drawings and documents, in the Suffolk County Clerk's office.
F. 
Planning Board approval of a final plat shall not be deemed an acceptance by the Town of any street or other land shown as offered for dedication to public use.
Planning Board approval of a final plat shall expire 90 days after the date of the Planning Board resolution authorizing the Chairman to sign the drawings.
A. 
Upon application by the subdivider, the Planning Board may extend the time for filing and recording such plat by not more than two additional periods of 90 days each; provided, however, that the Planning Board may require that the plat is revised to conform to any change in regulations or ordinances applicable to said plat subsequent to the resolutions of approval.
B. 
After the period during which a plat must be filed has expired, the Planning Board may nevertheless permit the subdivider to reapply to the Planning Board for final approval; provided, however, that the plat shall be revised to conform to any change in regulations or ordinances applicable to said plat subsequent to the first resolution of approval. The fee for such reapplication shall be 50% of the fee as established by Town Board resolution. No subdivider shall be permitted, however, to reapply for final approval pursuant to the provisions of this section if more than 30 days have passed since the date when the original final approval had expired.

The final plat shall be prepared by a licensed professional engineer or land surveyor and shall provide the information noted in this section and all other requirements set forth in § 335 of the New York State Real Property Law:

Size: 20 inches by 36 inches.
(2) 
Scale: one inch equals 100 feet or larger.
(3) 
If more than one sheet is required, a clearly drawn match line shall be shown on both sheets and on the key map.
B. 
Key map of the entire subdivision, which shall be the same as that required on the preliminary layout with the following additions:
(1) 
The final plat area being submitted for approval shall be shaded if it is only one section of the entire subdivision.
C. 
Boundary lines:
(1) 
Building zone districts.
(2) 
Special districts.
(3) 
Municipal areas.
D. 
General information required:
(1) 
Street rights-of-way and widening of street rights-of-way:
(a) 
Name.
(b) 
Location.
(c) 
Width.
(d) 
Notation on widenings where an offer of dedication is being made.
(2) 
Other rights-of-way and easements.
(a) 
Identification and description.
(b) 
Location.
(c) 
Width and other dimensions necessary for description.
(3) 
Lot layout:
(a) 
Number identification by a suitable system of consecutive numbers; numbers shall be circled or underlined.
(b) 
Lot lines with bearing and dimensions to the nearest 1/100 of a foot.
(c) 
Building setback lines with dimensions.
(4) 
Special parcels:
(a) 
Description of proposed use, including a note where an offer of dedication is being made.
(b) 
Boundary lines with bearing and dimensions to the nearest 1/100 of a foot.
E. 
Water supply system:

A Stormwater Pollution Prevention Plan consistent with the requirements of Chapter 86, Stormwater Management and Erosion Control, and with the terms of preliminary subdivision plan approval shall be required for Final Subdivision Plat approval. The SWPPP shall meet the performance and design criteria and standards in Chapter 86. The approved final subdivision plat shall be consistent with the provisions of Chapter 86.
