This chapter shall be known as the "Administrative Code of the Borough of Mountain Lakes" and is referred to herein as "the code."
A. 
Generally. The administrative functions, powers and duties, except as such are by law reserved to the Borough Council, shall be the responsibility of the Borough Manager as defined in Subsections B and D.
B. 
Administrative duties of Manager.
(1) 
The Office of the Manager, the Department of Public Works and Department of Police shall be under the direct administrative control of the Manager.
(2) 
The administrative functions of statutory and other agencies of the Borough government shall be supervised by the Manager, who may delegate functions as he sees fit. He shall actively seek out and consult with the agencies defined in this section.
C. 
Organization of departments.
(1) 
The internal organization of each department shall be determined by the director of the department, approved by the Manager, and adopted by resolution of the Council.
(2) 
Whenever, after organization, an activity or functional duty shall, by ordinance, be transferred from one department to another department of the government, all the functions, powers, and duties thereof shall be and are transferred as of the effective date of the ordinance.
D. 
Staff services. The Manager shall appoint and may remove such technical, professional, and clerical personnel as may be required for the administration of any office, board or commission. Insofar as practicable, staff services for any such office, board or commission shall be provided by full-time Borough staff.

A. 
Purpose.
(1) 
The Personnel Policy and Procedure Manual is a compilation of policies and procedures which govern and affect personnel administration for all administrative departments within the jurisdiction of the Borough of Mountain Lakes. The purpose of the manual is to improve the quality of the personnel management function.
(2) 
In addition, the manual serves as a repository which codifies existing rules and procedures relating to personnel administration in the Borough of Mountain Lakes. Its intent is to provide an orderly explanation of personnel regulations which aid in assuring equitable and fair treatment of applicants and employees in selection and promotion and in the provision of benefits and compensation without regard to political views, race, national origin, sex, religion, age or disability, provided that the latter does not directly affect job performance.
B. 
Adoption; revisions.
(1) 
The Personnel Policy and Procedure Manual is hereby adopted and incorporated herein, in its entirety, by reference, and a copy is available for inspection in the office of the Borough Clerk.
(2) 
The Borough Council shall by ordinance establish titles for public employment by the Borough and salary ranges for Borough employees.

(3) 
The Borough Council shall by resolution adopt and amend from time to time personnel policies and procedures including rules concerning the hiring and termination of employees, terms and conditions of employment, and regulations required to comply with applicable federal and state employment-related law. The personnel policies and procedures adopted pursuant to said resolution(s) shall be applicable to all officials, appointees, employees, prospective employees, volunteers and independent contractors of the Borough.

(4) 
The Borough Manager shall be responsible to implement and enforce the personnel practices adopted by ordinance or resolution authorized pursuant to this section. If there is a conflict between said personnel practices and any duly adopted and lawful collective bargaining agreement, personnel services contract or federal or state law, the terms and conditions of that contract or law shall prevail. In all other cases, the practices adopted pursuant to this section shall prevail.

The Council may appoint such other agencies, boards and committees as it may deem necessary.
