As used in this chapter, the following terms shall have the meanings indicated:
BOARDINGHOUSE
A private housing or dwelling unit where the owner, tenant or occupant is engaged in keeping two or more boarders, not related to him by blood or marriage, for a part of a day or longer period, and in serving food to lodgers, under expressed contract or agreed rate of payment.
HOTEL or MOTEL
A private housing or dwelling unit open to the public where the owner, tenant or occupant is engaged in keeping two or more guests for a part of a day or a longer period under expressed contract or agreed rate of payment.
LODGING HOUSE
A private dwelling unit where the owner, tenant or occupant is engaged in keeping two or more lodgers, not related to him by blood or marriage, for a part of a day or longer period under expressed contract or agreed rate of payment.
A. 
No person shall conduct or maintain a hotel, motel, lodging house or boardinghouse without first obtaining a permit from the Board of Health. The permit shall be issued on application.
B. 
Permit fees shall be as follows:

The application for a permit shall be made in writing and signed by the applicant, stating the type of establishment proposed to be maintained or conducted, the maximum number of guests, lodgers or boarders to be accommodated and the facilities to be offered.
The permit shall not be issued until the premises have been inspected and approved by the Health Officer.
A. 
Heat.
(1) 
The owner or operator of a hotel, motel, lodging house or boardinghouse shall provide heat for the inhabited rooms from September 15 to May 15 so that the temperature may be kept at 68º F. between 6:00 a.m. and 10:00 p.m.
(2) 
All heating shall be furnished by a central heating system or by portable or fixed electric heaters, except in an emergency. All lighting shall be electrical, except in an emergency.
B. 
Required facilities.
(1) 
Each establishment shall have for every six occupants or lodgers at least one bathtub or shower and at least one toilet and one washbasin.
(2) 
Every occupant shall be furnished with clean towels, washcloths, soap and drinking glasses, each for individual use. Adequate provision shall be made for furnishing and care of bed linens, all of which shall be kept clean and sanitary at all times.
C. 
General.
(1) 
All rooms shall be kept in a clean and sanitary condition. All inhabited rooms shall be adequately lighted and properly ventilated with one or more windows opening to the outside air. All outside doors and windows shall be screened to exclude flies and mosquitoes from April 1 to November 30.
(2) 
All sleeping quarters shall be above grade, shall have ceilings at least seven feet high and shall have at least 60 square feet of floor space for each bed.
(3) 
Rooms used for storage, preparation or service of food shall be subject to the requirements of the Retail Food Establishment Code.[1]

(4) 
The keeping or use on the premises of any cleansing agents containing hydrocyanic acid or other dangerous poisons is prohibited.

Any person who violates or neglects to comply with any provision of this chapter or notice issued pursuant thereto shall, upon conviction thereof, be liable to a penalty of not less than $5 nor more than $500 for each violation.
