Before any plumbing work requiring authorization
according to the provisions of this chapter shall be started, a permit
shall be obtained from the Plumbing Inspector, except that no such
permit shall be required for factory-manufactured homes that bear
the insignia of approval as per Chapter D, Part 1200, of the New York
State Fire Prevention and Building Code Council as it pertains only
to the components structure. No such permit shall be required for
repairs involving only the working parts of a faucet or valve, the
clearance of stoppages or stopping of leaks and the replacement of
a defective faucet or valve with a new one of the same type, provided
that no changes are made in the piping to the fixture. This permit
shall be obtained by the plumber who, or whose firm, has been employed
to do the plumbing work or by a homeowner as provided in this chapter.

Special permission must be obtained from the
City Health Department and City Engineer for the installation of septic
tanks or cesspools before a permit can be issued by the Plumbing Inspector.
Sewerage systems, including septic tanks and cesspools, not otherwise
provided for by this chapter shall be in accordance with Part 75 and
Appendix 75-A of Title 10 of the New York Codes, Rules and Regulations.

A. Any permit
required by this chapter shall be issued to any person who owns and
resides in either a single- or two-family dwelling used exclusively
for living purposes, including the usual accessory buildings and quarters
in connection with such dwelling, and to any person who is building
and constructing either a single- or two-family dwelling on lands
owned by him; provided, however, that not more than one permit shall
be issued in any twelve-month period to any person building and constructing
such a dwelling. Plumbing work included under this permit shall include
all plumbing work to be performed inside the walls of said dwelling
or accessory buildings and quarters in connection with such dwelling,
and such plumbing work shall be personally performed by the owner
of the dwelling. A homeowner will not be permitted, under this permit,
to make any connections to the water system or the sewer system of
the City.
B. Property
owners, or people with legal control of residential property, may
be issued any permit required by this chapter, as long as such plumbing
work does not include work to be performed inside the wall of said
building. A property owner will not be permitted, under this permit,
to make any connections to the water system or sewer system of the
City.

A. Permits
for plumbing or drainage shall be issued by the Plumbing Inspector
only to a master plumber duly registered with the Plumbing Inspector
or to any person holding a master plumber’s license issued by
a municipality of the State of New York pursuant to the provisions
of this section and for work to be performed under a homeowner’s
or contractor’s permit issued pursuant to the provisions of
this chapter.
B. Any person holding a master plumber’s license issued by any municipality of the State of New York may apply for and shall be granted a permit by the Plumbing Inspector to do a specified job of plumbing work in the City and districts of the Towns of Niskayuna and Rotterdam under the jurisdiction of the City, and such permit shall be granted without examination upon payment of a fee of $400 for each job under $3,000, and, for each job over $3,000, the fee shall be $400 plus 1% of the plumbing contract in addition to the charges as set forth in §
138-43. Such permits shall expire when the specified job is completed.
A. No permit shall be issued until specifications and
plans showing necessary details of all water pipe, sewer pipe and
plumbing fixtures have been submitted to the Plumbing Inspector by
the plumbing contractor, architect or engineer and these plans have
been checked to assure that the work will conform to the provisions
of this chapter.
B. If the plans indicate that any provisions of this
chapter are not being complied with, they shall be rejected and no
permit issued until they have been revised to comply with this chapter.
C. If, in the course of the work, it is found necessary
to make any change from the approved plans, specifications or work,
revised plans and specifications shall be submitted and a supplementary
permit shall be issued to cover the change before any part of the
change is commenced.

No permit or plumbing and drainage work shall
be issued until the fees, as provided herein, are paid by the employing
or master plumber or homeowner to the Plumbing Inspector. The Plumbing
Inspector shall determine from the plans and specifications the fees
required by this chapter using the following charges:
A. The fee for application for a commercial plumbing
permit shall be $50.
B. The fee
for application for a residential plumbing permit shall be $25.
C. Where the real property is situated within the City
of Schenectady:
(1) One-family house or one apartment, one complete bathroom:
$20, plus $6 for each fixture.
(2) Two-family house, two complete bathrooms: $40, plus
$6 for each fixture.
(3) Toilet rooms in commercial and industrial buildings
each: $50, plus $6 for each fixture.
(4) Replacement or addition of the following plumbing
fixtures:
(a)
Septic tanks and cesspools: $10.
(c)
Soda fountain fixtures: $10.
(d)
Air-conditioning units: $10.
(e)
Oil separator units: $10.
(g)
Garbage disposal units: $10.
(j)
Automatic washing machines: $6.
(s)
Hot-water range boilers: $6.
(t)
Gas hot-water heaters: $6.
(u)
Electric water heaters: $6.
(w)
Roof drains connected to storm sewers: $6 each.
(5) Permits for the City, Niskayuna and Rotterdam:
(b)
Water service inspection: $50.
(c)
Sanitary sewer lateral inspection: $50.
(d)
Storm sewer lateral inspection: $50.
D. Where the property is situated outside the City and
will obtain its water supply from water furnished by the City or the
sewage from said property will eventually be discharged through the
sewage system of the City, there shall be a charge of $50 for each
and every inspection made by the Plumbing Inspector, plus an inspection
fee of $6 per fixture for all residential, commercial and industrial
structures.
E. Penalties.
(1) Any
person, company or business entity found not in compliance with this
chapter shall be subject to immediate revocation of permit privileges
for the job being performed and suspension of all future work privileges
until the job is brought into compliance, a stop-work order, recovery
of cost of materials, labor and inspection fees at prevailing rates
and forfeiture of any permit fee and/or deposit.
(2) Failure
to comply with the terms of this chapter shall be a violation as defined
by the Penal Law of the State of New York and shall be punishable
by a fine not exceeding $1,000 or imprisonment not exceeding 15 days
for each day of violation, or by both such fine and imprisonment,
or by a penalty of not less than $350 nor more than $1,000 for each
day of violation to be recovered by the City in a civil action.
(3) A
separate offense shall be deemed committed on each day during or on
which noncompliance with the terms of this chapter occurs or continues
unabated after the time limit set for abatement of the violation.
(4) Any
person issued a notice of violation pursuant to any provision of this
chapter shall be subject to an administrative fee of $50, and such
administrative fee shall be charged against the land upon which the
notice of violation was issued as a municipal lien or such administrative
fee shall be added to the tax rolls as an assessment or levied as
a special tax against said property or recovered in a civil suit against
the person to which the notice of violation was issued.

The permit and inspection fees hereinabove set
forth entitles the plumbing contractor or the homeowner to one inspection
of the rough plumbing work and one inspection of the final plumbing
work. If, for any reason, the Plumbing Inspector is required, in his/her
judgment, to make additional inspection of the rough plumbing work
or the final plumbing work, an additional fee of $50 for each additional
inspection shall be charged to and paid by the plumbing contractor
or the homeowner.
Upon written notice from the Plumbing Inspector,
the owner or lessee shall be required to correct, within three days,
any and all unsanitary or defective conditions which are likely to
have immediate detrimental effect. He shall also correct, within a
time specified by the Plumbing Inspector, other unsanitary or defective
conditions which may, over a period of time, have a detrimental effect
on health.
The Plumbing Inspector or his representative
or any duly authorized City representative shall have the right to
inspect any plumbing system at such times as may be deemed necessary
to protect the public health.

Upon the satisfactory completion and final inspection
of the plumbing system, a certificate of approval shall be issued,
upon request, by the Plumbing Inspector to the plumber or permit holder
to be delivered to the owner.
For the purpose of securing for the public the
benefits of new developments in the plumbing industry and yet ensuring
public health, the Examining Board of Plumbers hereinafter provided
for may make or cause to be made, at the expense of the promoter or
submitter, investigation of new materials, equipment and appliances
suitable for use in the City not provided for in this Code and shall
make rules setting forth the conditions under which such materials,
equipment and appliances may be used.
Persons other than homeowners shall be examined
and conduct their business in accordance with the rules and regulations
of the Examining Board of Plumbers as hereinafter provided for.
