In accordance with § 17.1-281A, Code
of Virginia (1950), as amended, there is imposed an assessment of
$2 upon each civil, criminal and traffic action filed in the Circuit
or District Courts of the County. The assessment provided shall be
in addition to all other costs prescribed by law.

In accordance with § 17.1-281C, Code of Virginia (1950),
as amended, provided that the County has received from the Virginia
Department of General Services certification that the Winchester-Frederick
Joint Judicial Center is not in compliance with the current safety
and security guidelines contained in the Virginia Courthouse Facility
Guidelines, and that the Winchester-Frederick Joint Judicial Center
cannot be feasibly renovated to correct such noncompliance, as to
all cases commenced during such time as that certification remains
valid, there is imposed a supplemental assessment of $3 upon each
civil, criminal and traffic action filed in the Circuit or District
Court of the County. Such supplemental assessment under this section
shall not be assessed in any civil action if the amount in controversy
is $500 or less. The supplemental assessment provided shall be in
addition to all other costs prescribed by law.
The purpose of the assessment imposed is to
provide funding for the construction, renovation or maintenance of
the Courthouse or jail and court-related facilities and to defray
increases in the cost of heating, cooling, electricity and ordinary
maintenance of the same.
This assessment shall not apply to any action
in which the Commonwealth of Virginia or any political subdivision
thereof or the federal government is a party and in which the costs
are assessed against the commonwealth, political subdivision or federal
government.
The assessment imposed shall be collected by
the Clerk of court in which the action is filed and remitted to and
held by the Treasurer, subject to disbursement authorization by the
Board of Supervisors of Frederick County, Virginia.
