This article shall be known as the "Games of Chance Licensing Law."
The definitions as set forth in Article 9-A of the General Municipal
Law of the State of New York are incorporated in this article as if set forth
in full herein.

Subject to the provisions contained herein, the rules and regulations
of the New York State Racing and Wagering Board, the provisions of Article
9-A of the General Municipal Law and the Constitution of the State of New
York, and all amendments of the aforesaid statutes, rules and regulations,
it shall be lawful for any authorized organization, upon obtaining a license
therefor under the provisions of this article, to conduct games of chance
within the territorial limits of the Town of Caledonia.
The provisions of Article 9-A of the General Municipal Law, and any
amendments thereto, shall control the licensing of organizations and conduct
of games of chance in the Town of Caledonia, and this article incorporates
all of the provisions of said statute by reference as if set forth in full
herein.
The conduct of games of chance on Sundays is hereby expressly authorized,
except as otherwise provided in Article 9-A of the General Municipal Law of
the State of New York.
This article shall take effect after approval thereof by a majority
of the qualified electorate voting on the proposition at the General Election
on November 8, 1977, and the publication thereafter of said article as provided
by the Town Law.

Pursuant to Subdivision 2 of Section 9 of Article
I of the State Constitution, it shall be lawful for any authorized organization, as defined in § 476 of Article 14-H of the General Municipal Law, upon obtaining the required license, to conduct bingo games within the territorial limits of the Town of Caledonia, subject to the provisions of this article, Article 14-H of the General Municipal Law, Article 19-B of the Executive Law and the rules and regulations of the State Racing and Wagering Board.
The unauthorized conduct of a bingo game and any willful violation of
any provision of this article or Article 14-H of the General Municipal Law
shall constitute and be punished as a misdemeanor and shall result in the
forfeiture of any license issued under this article or Article 14-H of the
General Municipal Law and shall render the offender ineligible to apply for
a license under this article and Article 14-H of the General Municipal Law
for one year thereafter.
Limited-period bingo shall be conducted in accordance with the provisions
of Article 14-H of the General Municipal Law and the rules and regulations
of the Control Commission.
The conduct of games of bingo on the first day of the week, commonly
known and designated as "Sunday," is hereby expressly authorized, subject
to the provisions of this article, Article 14-H of the General Municipal Law,
the rules and regulations of the State Racing and Wagering Board and other
applicable statutes, laws and rules and regulations.

Each licensee licensed to conduct bingo in the Town of Caledonia shall
pay to the Town Clerk of Caledonia a license fee as required by § 481
of the General Municipal Law for each bingo occasion and, in addition, shall
pay to the Caledonia Town Clerk a fee as required by § 491 of the
General Municipal Law to defray the cost to the Town of Caledonia of administering
the provisions of Article 14-H of the General Municipal Law and Article 19-B
of the Executive Law.
In addition to other fees provided by law, upon filing of the statement
of receipt after the conclusion of any occasion of bingo as provided by § 491
of the General Municipal Law, the authorized organization furnishing such
statement of receipts shall pay to the Town Clerk as an additional license
fee a sum based on the reported net proceeds for the occasion covered by such
statement and determined in accordance with such schedule as shall be established
from time to time by the State Racing and Wagering Board.
This article and any license issued thereunder shall, in case of conflict,
be deemed automatically amended to conform to any future enactment by the
Legislature of the State of New York of any new law or laws relating to any
part or parts of the subject matter of this article and of any amendments
to, rescissions of or other changes in Article 14-H of the General Municipal
Law and Article 19-B of the Executive Law of the State of New York, and may
be amended by the Town Board as provided by law.
This article shall become effective upon approval of the same by a majority
of the qualified electors of the Town of Caledonia voting on a proposition
therefor duly submitted to a special election to be held within the Town in
accordance with the provisions of the General Municipal Law, Election Law,
Town Law and other applicable provisions of law, and upon filing with the
State Racing and Wagering Board a copy of this article within 10 days after
its approval as above provided.
