A. 
The Common Council of the City of Hornell has received numerous complaints regarding the uncontrolled defecation of dogs on public and private property. In order to promote the health, safety and general welfare of the citizens of this City it shall be unlawful for the owner or person in custody or control of any dog to allow such dog to defecate upon the public property of the City, the highways of the state and the private property of another other than the owner or keeper of said dog.
B. 
If such dog shall defecate upon property other than that of the owner or keeper of the dog, the owner or keeper must immediately clean up the feces and make proper disposition of it so as not to endanger the health and safety of the public
C. 
If any dog shall defecate upon the property of the owner or keeper of such dog, the owner or keeper must clean up the feces and make proper disposition of it within three days so as not to endanger the health and safety of the public.
The City of Hornell Codes Officer, Health Officer, Dog Control Officer and Hornell Police Department are charged with the enforcement of this provision of the law and/or ordinance. A complaint must be filed with any of the above agents or agencies identifying the owner or keeper of said dog.
Any person who violates any provision of this article or any of the rules and regulations made pursuant hereto shall be liable for each offense upon conviction before the City Court Judge to a fine of not more than $250. Each day's failure to comply with such provision shall constitute a separate violation.
