The Board of Trustees acknowledges that with
increasing frequency the Village has received reports of domestic
animals being caught in nonhumane-type traps, such as the Conibear
and leghold spring-loaded traps. It is the determination of the Board
of Trustees that the use of such traps is inhumane, both with respect
to the possibility of domestic animals being caught in the same and
with respect to the pain and suffering caused to the wildlife sought
to be trapped therein. Further, it is the determination of the Board
of Trustees that such traps constitute a real and present danger to
small children. It is the intention of this article to eliminate the
use of such inhumane traps and reduce the risk of injury to domestic
animals and small children, thereby promoting the general health,
safety and welfare of the residents of the Village of Old Field.
As used in this article, the following terms
shall have the meanings indicated:
OFFENSE
The setting of one or more traps of the types prohibited
by this article.
PROPERTY
All public and private real property in the Incorporated
Village of Old Field.
SET
The setting up, placing, depositing or leaving of any trap
on any property.
TRAP
Any device which is commonly used to snare or kill beaver,
otter, fisher, mink, muskrat, skunk or raccoon or other wildlife.
No person, entity or corporation shall set any
trap of the Conibear or leg-hold spring-loaded type on any property
within the Incorporated Village of Old Field. Humane box-type traps,
such as the Havahart, shall, however, continue to be permissible traps
for the trapping of wildlife on real property within the boundaries
of the Incorporated Village of Old Field.
No trap shall be set within the boundaries of
the Incorporated Village of Old Field unless the name, address and
telephone number of the owner is affixed thereon in a legible manner.

Any trap not having the name, address and telephone
number of the owner thereon shall be confiscated by appropriate Village
personnel.
To the extent that this article is inconsistent with any state, county or town law regulating the trapping of wildlife and especially to the extent that it is inconsistent with Article
II of the Environmental Conservation Law of the State of New York, this article shall supersede and take precedence over said sections or laws.
