The provisions of this article shall apply except
where it is necessary to stop a vehicle to avoid conflict with other
traffic or in compliance with the directions of a peace officer or
official traffic control device.

A. Except
as provided herein, no owner or operator of a vehicle, equipment or
trailer shall park the same or leave the same parked, standing or
stopped upon any highway or private road open to public motor vehicle
traffic in the Village, including the right-of-way of any highway
or private roads open to public motor vehicle traffic.
B. Except
as provided herein, no vehicle, equipment or trailer shall drive across
the right-of-way of any highway or private road open to public motor
vehicle traffic except upon a driveway approved by the Village, unless
said vehicle, equipment or trailer is actively being used in connection
with deliveries, repairs, construction or the performing of service
to or on the property that is immediately adjacent to said right-of-way.
C. Vehicles,
equipment and trailers which are actively being used in connection
with deliveries, repairs, construction or the performing of service
to or on a property within the Village shall be permitted to drive
across or to park, stop or stand upon the unpaved portion of the right-of-way
of any highway or private road open to public motor vehicle traffic
located immediately adjacent to that property or, if unavailable,
on the paved portion of the highway or public road, provided that
the operator of said vehicle, equipment or trailer complies with the
following:
(1) No
vehicle, equipment or trailer shall drive across, or park, stand or
stop upon, the right-of-way of any highway or private road open to
public motor vehicle traffic in a manner that causes damage to such
right-of-way.
(2) When
driving across or parking, standing or stopping upon the right-of-way
of any highway or private road open to public motor vehicle traffic
cannot be avoided, the operator of the vehicle, equipment or trailer
shall take the appropriate protective measures in order to avoid damage
to the right-of-way.
(3) No
person or entity may park any vehicle, equipment or trailer upon a
right-of-way of any highway or private road open to public motor vehicle
traffic in any manner which restricts, encumbers or obstructs such
highway or private road.
D. No owner
or operator of a vehicle shall park said vehicle or leave it parked,
standing or stopped upon any public street or private road open to
the public in the Village of Old Field, including any right-of-way
thereof, unless said vehicle:

(1) Has
a current, valid New York State certificate of inspection, or the
equivalent thereof for any vehicle registered outside the State of
New York, affixed on the vehicle in the proper location.
(2) Is
properly registered in accordance with Article 14 of the Vehicle and
Traffic Law of the State of New York and has a valid registration
certificate affixed on the vehicle in the proper location.
E. Any person
or entity charged with violating any provision of this section shall,
upon conviction thereof, be guilty of a violation punishable by a
fine of not more than $250.

F. In addition
to a fine, the owner and operator of a vehicle, equipment or trailer
that causes damage to Village-owned right-of-way shall be jointly
and severally liable to the Village for the cost to repair any such
damage.
