No fireplace, stove, furnace, heating device, cooking unit, incinerator, boiler, firebox or other device which requires an outlet to convey smoke or hot gases to the outer air shall be constructed, installed or maintained unless a permit shall first have been obtained from the Village Building Inspector.
An application, along with drawings and specifications of the proposed construction or installation, shall be submitted to the Building Inspector and, after approval of same and construction or installation in accordance with same, an inspection shall be made by the Building Inspector and a certificate of occupancy issued prior to the operation of the device.
The installation shall meet the standards of the New York State Building Code, Part 5, entitled "Heat-Producing Equipment," and the State Energy Conservation Construction Code and, if applicable, shall be installed according to the manufacturer's specifications.
A fee of twenty-five dollars ($2:5.) payable to the Village of Old Field, shall accompany each application.
A. 
No person or persons shall construct a chimney in or attach any chimney to any dwelling or structure unless such chimney is either a masonry chimney designed for the use of all types of fuels and is built up from the footings below grade or a factory-fabricated chimney approved as a result of tests and listed by a nationally recognized laboratory for use with all types of fuel and is installed in accordance with the conditions of approval and listing.
B. 
The minimum free area of the chimney shall be equivalent to a seven-inch round flue.
All chimneys, smokestacks or similar devices for conveying smoke or hot gases to the outer air and all the devices to which they are connected shall be constructed, installed and maintained in such a manner as not to create a hazardous condition.
Every factory-built chimney shall be approved by the Underwriters Laboratories, Inc., and shall be installed in accordance with the conditions of the approval. Also every factory-built chimney shall be equipped with a cleanout tee and one of the following methods of termination used:
A. 
A housing assembly with an open top, equipped with a stainless steel cleanout tee.
B. 
A housing assembly with a rain cap, which shall be designed to prevent accumulations of soot or other combustion products on the roof of the building.
Factory-built chimney housings which are field-assembled shall be equipped with steel tension straps secured to the roof framing by nails and to the chimney housing by bolts.
Factory-built chimney housings which are factory-assembled must be secured to the roof framing with screws or bolts.
Any person committing an offense against any provision of this chapter shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
