The office of Township Manager is hereby created.
The Board of Supervisors hereby delegates, subject to recall, any of its nonlegislative powers and duties to the Township Manager.
A. 
The compensation of the Township Manager shall be as set forth by resolution of the Board of Supervisors.

B. 
He shall give bond to the township, with sufficient surety, to be approved by the Board of Supervisors in the sum as set from time to time by resolution of the Board of Supervisors, conditioned for the faithful performance of his duties.

The Township Manager shall be appointed, hold office and be subject to the duties and liabilities imposed by 53 P.S. § 66301 of the Second Class Township Code.
A. 
Said office shall be filled by appointment for an indefinite term by majority vote of this Board. He shall serve at the pleasure of the Board and may be removed at any time by a majority vote of the Board.
B. 
The Manager shall be chosen solely on the basis of his executive and administrative abilities, with special reference to the duties of his office as outlined below. He need not be a resident of the township or of the Commonwealth of Pennsylvania at the time of his appointment; but during the tenure of his office, he may reside outside the township only with the approval of the Board.
C. 
The Manager shall be the chief administrative officer of the township and shall be responsible to the Board for the proper and efficient administration of the affairs of the township. Until modified by amendment to this chapter, the powers and duties of the Township Manager shall include:
(1) 
Supervision and responsibility for the activities of all township departments.
(2) 
Attendance at all meetings of the Board of Supervisors, the Township Planning Commission, the Zoning Hearing Board and the Franconia Sewer Authority, with the right to take part in discussions. The Manager shall be entitled to receive notice of all regular and special meetings of the Board and the other aforementioned bodies.
(3) 
Preparation of agendas for all meetings.
(4) 
All complaints by township residents, taxpayers, landowners and other persons having dealings with the township shall be referred initially to the Manager. He, or an officer designated by him, shall investigate and dispose of such complaints. The Manager shall thereafter report on such matters to the Board.
(5) 
Administration and enforcement of all applicable statutes and ordinances within the township.
(6) 
Preparation and submission to the Board of Supervisors, in sufficient time to meet the schedule set forth in the Second Class Township Code, a preliminary budget for the next fiscal year.
(7) 
Administration of the budget after its adoption by the Board of Supervisors.
(8) 
Preparation and submission to the Board of an annual report of township affairs, and such special reports as may be necessary.
(9) 
Conducting the general affairs of the township, including purchasing, collection of moneys, administration and enforcement of contracts, leases and franchises subject to the provisions of applicable statutes, ordinances and resolutions.
(10) 
If expressly appointed thereto on an annual basis by the Board, service as Township Secretary, Township Treasurer or any other township office.
(11) 
All employees and officers of the township, including the Secretary, Treasurer and Engineer, but excluding members of the Board of Supervisors, elected Auditors, the elected Tax Collector, and the Township Solicitor, shall be under the Manager's supervision and control, and he shall, with the approval of the Board of Supervisors, appoint and remove all such employees, with the exception of elected officials, the Secretary, Treasurer, Solicitor and Engineer, in accordance with the provisions of such township personnel rules as may hereafter be adopted by the Board. All appointments and removals shall be reported to the Board at its next meeting. The Manager shall have the power to direct the Township Solicitor to perform any professional duties pertaining to the affairs of the township and shall cooperate with the Board, the elected Auditors, and the elected Tax Collector, in coordinating his duties with theirs.
(12) 
In cooperation with the Chief of Police or ranking police officer, he shall see that all laws and ordinances are enforced.
