The Board of Supervisors may, from time to time,
amend, supplement, change, modify or repeal this chapter, including
the Zoning Map attached hereto, by proceeding in the manner hereinafter
set forth.

A. Before voting on the enactment of an amendment to
any of the provisions of this chapter, the Board of Supervisors shall
hold a public hearing thereon pursuant to public notice. In addition,
if the proposed amendment involves a Zoning Map change, notice of
said public hearing shall be conspicuously posted by the Township,
at points deemed sufficient by the Township, along the perimeter of
the tract to notify potentially interested citizens. The affected
tract or area shall be posted at least one week prior to the date
of the hearing.
B. In the case of an amendment other than that prepared
by the Township Planning Commission, the Township shall submit each
such amendment to the Township Planning Commission at least 30 days
prior to the hearing on such a proposed amendment to provide the Township
Planning Commission an opportunity to submit recommendations.
C. At least 30 days prior to the public hearing on an
amendment, the Township shall also submit the proposed amendment to
the Montgomery County Planning Commission for recommendations.
D. If, after any public hearing held upon an amendment,
the proposed amendment is changed substantially or is revised to include
land previously not affected by it, the Board of Supervisors shall
hold another public hearing pursuant to public notice before proceeding
to vote on the amendment.
E. Notice of the proposed enactment of an amendment shall
be given and shall include the time and place of the meeting at which
passage will be considered and a reference to the place within the
Township where copies of the proposed amendment may be examined without
charge or obtained for a charge not greater than the cost thereof.
The Township shall publish the proposed amendment once in one newspaper
of general circulation in the municipality not more than 60 days nor
less than seven days prior to passage. Publication of the proposed
amendment shall include either the full text thereof or the title
and a brief summary, prepared by the Township Solicitor and setting
forth all of the provisions in reasonable detail. If the full text
is not included in the notice, a copy thereof shall be supplied to
a newspaper of general circulation in Franconia Township at the time
public notice is published, and an attested copy of the proposed amendment
shall be filed in the County Law Library. In the event that substantial
amendments are made in the proposed amendment before voting upon enactment,
the Township shall, at least 10 days prior to enactment, readvertise
in one newspaper of general circulation in Franconia Township a brief
summary setting forth all the provisions in reasonable detail, together
with a summary of the amendments.
Every application for amendment of the Zoning
Ordinance presented to the Board of Supervisors shall contain, where
applicable:
A. The applicant's name and address and his representative
and the interest or every person represented in this application.
B. A plan showing the extent of the area to be rezoned,
streets bounding and intersecting the area and the land use and zone
classification of abutting districts.
C. A statement of the circumstances in the proposed district
and the abutting districts and any other factors on which the applicant
relies as reasons for supporting the proposed rezoning.
D. The approximate time schedule for the beginning and
completion of development in the area.
E. A site plan to scale, indicating the location of structures,
uses and areas for off-street parking and loading.
For the purpose of defraying expenses of advertising,
etc., applications for amendments shall be accompanied by cash payments
to the Township Treasurer in accordance with a Fee Schedule adopted
by resolution of the Board of Supervisors upon the enactment of this
chapter or as such schedule may be amended by resolution of the Board
of Supervisors.
