Pursuant to Section
3.3 of the Town Charter, as amended, all employees of the Town, except employees of the Board of Education, shall be appointed based upon merit and fitness alone or removed for cause. Pursuant to Section
2.4 of the Town Charter, as amended, the Town Council, hereinafter referred to as "Council," shall adopt and revise as necessary a uniform Personnel Policy for all employees of the Town, except employees of the Board of Education. The provisions of this chapter shall apply to all municipal employees except employees of the Board of Education and shall set forth uniform guidelines concerning personnel.
As used in this chapter, the following terms shall have the meanings
indicated:
DEPARTMENT HEAD OR SUPERVISOR
Any appointed employee who has direct supervision and responsibility
for personnel, records, funds, maintenance and service to be performed by
a municipal department.
FULL-TIME EMPLOYEE
Any person who works year round in excess of 20 hours per week. "Regular
full-time employee" and "full-time employee" mean the same thing.
TOWN COUNCIL (also referred to as "COUNCIL")
The seven-member elected legislative and policy-making body of the
Town of East Hampton established pursuant to the Town Charter. For purposes
of this chapter, prior to the Town election of November 7, 1989, "Council"
shall also mean "Board of Selectmen."
TOWN MANAGER
The chief executive and administrative officer of the Town appointed
pursuant to the Town Charter and the designated appointing authority for all
municipal employees except employees of the Board of Education.
Any employee may be dismissed for just cause. An employee who is dismissed
shall be given written notice of the reasons for the dismissal action, copies
of which notice shall be retained by the Town Manager in the employee's
personnel file.
No municipal employee shall engage in any outside employment which will
impair the performance of his duties or be detrimental to the municipal service.
Employees with any grievances arising out of their employment by the
Town, except requests for the general wage increase, shall have the right
of appeal to their immediate department supervisor. Appeal shall be made in
writing and may be presented by the employee individually or by said employee's
selected representative. In the event the grievance cannot be settled between
the department supervisor and the employee, or his selected representative,
the department supervisor shall submit a report in writing to the Town Manager,
whose decision shall be final in the matter.
Normal retirement from municipal duty for personnel shall be at the
age of 65, and the day of such retirement shall be the last day of the month
in which the employee's 65th birthday is attained. However, an employee may
continue to work past his normal retirement date to the extent provided by
state and federal law.
The Town of East Hampton shall take whatever steps are necessary to
ensure compliance with the Connecticut Fair Employment Practices Act, Equal Employment and Opportunities Act, and all other applicable
federal and state laws concerning municipal employees.
