The Town Council enact this article pursuant
to the authority of § 7-148 of the Connecticut General Statutes
and toward the advancement of the public health, safety and welfare,
expressly for the purpose of guaranteeing the safety of travelers,
and the free and unfettered use of Town property where the Town has
determined the same to be permissible.
No person, association, corporation, or other
entity shall be permitted to erect, construct, repair, place, replace,
plant, keep or maintain any structure, fence, stand, barricade, sign,
or other object except mailboxes, whether temporary or permanent in
nature, upon any Town right-of-way and/or within six feet of the edge
of the traveled portion of any Town road, or upon any Town property,
without first obtaining written approval from the Town Manager.

No person, association, corporation, or other entity shall be permitted to obstruct any public sidewalk, public walkway or public passageway by placement of any object thereon or permit any plant or tree to obstruct same. The Superintendent of Public Works shall direct any entity deemed in violation of this section to remove said object or planting within five days of receipt of written notification. Failure to act upon notification shall permit the Superintendent of Public Works to remove the offending object or planting and bill the offending entity and/or lien said property for the costs of removal, in addition to the penalties described in §
273-5.
A violation of this article shall subject the
violator or violators to a fine of $100 as provided by § 7-148(c)(6)(C)(v)
of the Connecticut General Statutes. Each day of willful noncompliance
with this article shall be considered a separate violation hereof.
