This chapter shall be known and may be cited as the "Village of Bellevue
Garage Sale Ordinance."
As used in this chapter, the following terms shall have the meanings
indicated:
GARAGE SALE
Includes the terms "basement sale," "attic sale," "yard sale," or
other types of so-called residential sale of used tangible personal property
such as clothing, household effects, tools, garden implements, toys, recreation
equipment, or other used or secondhand items customarily found in and about
the home and advertised in a manner whereby the public at large is or can
be aware of such a sale.
Before a garage sale can be conducted, the homeowner or occupant of
the premises at which said sale shall be held shall obtain a permit from the
Village Clerk. The permit shall contain the name of the applicant and the
duration of the sale. No more than four permits per address, per calendar
year may be issued for the conducting of a garage sale; in addition at least
30 days must elapse between each of the four permitted garage sales on the
premises covered by the permit. The fee for such permit shall be set by resolution
of the Village Council from time to time.
Each garage sale shall be limited to four days of operation and shall
not be conducted before 8:00 a.m. or after 8:00 p.m. of each day.
The garage sale shall be conducted only by the homeowners or occupants.
Joint garage sales may be held with other homeowners or occupants of the neighborhood,
provided that the permit lists all homeowners or occupants involved in the
sale. No merchandise of any nature shall be brought in from any other source
in connection with such sales. The limitations of this section shall not be
applicable, however, when the permit is obtained and the sale conducted by
a church, school, veterans' organization, fraternal or religious society or
other civil or charitable nonprofit organization.
The term "garage sale" shall not apply to the homeowner or occupant
who during the normal course of housekeeping advertises or otherwise offers
for sale an individual piece of furniture or an appliance being replaced or
no longer needed.
A violation of this chapter is a municipal civil infraction. The penalty
for a violation that is a municipal civil infraction shall be a civil fine
in an amount set by the Village Council from time to time.
